Thomas Whittle of Harby 1784 Will

In the Name of God Amen I Thomas Whittle of Harby in the County of Leicester yeoman being of sound and Disposing mind Memory and Understanding Do make and Ordain this my Last Will and Testament in Manner following

First I will that all my Just Debts and Funeral Expences be paid and satisfied

I Give and Devise unto my Nephew John Whittle of Harby aforesaid Victualler All those three Closes or grounds Inclosed with the Appurtenances being and lying within the Lordship of Liberties of Hose in the County of Leicester aforesaid called or known by the Names of the Dales Closes containing together by Estimation eight Acres and an half or thereabouts (be the same more or Less) and now in the Possession of my said Nephew John Whittle or his Assigns To Hold the same unto my said Nephew John Whittle his Heirs and Assigns for ever Subject nevertheless and Charged and Chargeable with the payment of the several Legacies or sums of Money herein after mentioned (that is to say)

I Give and Bequeath unto my sister Mary Whittle of Harby aforesaid the sum of five Pounds to be paid to her within Six Months after my Decease

Also I Give and Bequeath unto my Nephew William Whittle the sum of Fifteen Pounds

Also I Give and Bequeath unto my Nephew James Whittle the sum of Twenty Pounds

Also I Give and Bequeath unto my Niece Ann the wife of Edward Morley of Cotgrave (Blacksmith) in the County of Nottingham the sum of Ten Pounds

Also I Give and bequeath unto my Niece Mary Whittle the sum of Fifteen Pounds

Also I Give and Bequeath unto my Niece Elizabeth Whittle the Wife of John Whittle Farmer of Harby aforesaid the sum of ten Pounds

Also I Give and Bequeath unto my Niece Sarah the Wife of William Freck of Harby aforesaid Farmer the sum of fifteen Pounds

Also I Give and Bequeath unto my Niece Elizabeth Hickling the Wife of George Hickling of Cotgrave aforesaid Framework Knitter the sum of Ten Pounds

Also I Give and Bequeath unto my Nephew James Jackson Son of James Jackson of Harby aforesaid the sum of five Pounds

And my will is that all the aforesaid Legacies herein bequeathed unto my aforesaid Nephews and Nieces shall be paid by my said Nephew John Whittle one or More in one year at the discretion of him my said Nephew John Whittle aforesaid so as that they be all paid within Seven years next after my decease

And my Will further is that all such of the aforesaid Legacies as shall remain unpaid more than Twelve Months after my Decease shall bear Interest after the rate of two Pounds a year for one Hundred pounds during all the time from thence untill they are Paid

Also my Will further is that if any of my said Nephews or Nieces shall die before his or her respective Legacy shall be paid his or her said Legacy shall be paid by my said Nephew John Whittle unto and amongst all the Children of such Legatee if any such there be if not to sink into and become part of my Personal Estate for the benefit of my Executor hereinafter named

And I do hereby charge and make Chargeable my said Three Closes in Hose aforesaid herein before mentioned Given and Devised to my said Nephew John Whittle Victualler with the payment of the said several Legacies or Sums of Money and Interest as they respectively become payable by Virtue of this my Will

I Give and Bequeath unto my Nephew John Adcock the sum of one shilling to be paid by my Executor hereinafter named within one month next after my Decease

And as to and for and Concerning All rest And residue of my Goods Cattle Chattels ready securities for monies and all other my Personal Estate whatsoever and wheresoever and of what Nature or kind soever I Give and Bequeath the same and every part thereof unto my said Nephew John Whittle Victualler whom I do hereby make ordain and Constitute and appoint Sole Executor of this my Last will and Testament hereby revoking and making Void all former and other Will and Wills by me at any time heretofore made Declaring this only to be my Last Will and Testament

In Witness whereof I have to this my Last Will and Testament contained in two sheets of Paper to the first of which I have set my Hand and to the Last my Hand and Seal this Twenty Fifth day of January One thousand seven Hundred and Eighty Two

Signed sealed published and declared by the said Testator Thomas Whittle as and for his last Will and Testament in the presence of us who subscribed our Names as Witnesses hereto in the presence and at the request of the Testator

On the fourteenth day of December 1784 John Whittle to sole Executor named in the within written will, was sworn to the due Execution thereof & made oath that the whole of the testators personal effects did not amount to five pounds
