George Taylor of Stathern 1847 Will

This is the last Will and Testament of me George Taylor of Stathern in the County of Leicester Jobber

I direct my just debts funeral and testamentary expenses to be paid by my Executrix hereinafter named as soon as conveniently may be after my decease out of my personal Estate

I give and bequeath unto Mary Ellen Kinning Niece to my Wife the Legacy or Sum of one hundred pounds to be paid to her free from Legacy duty within six Calendar Months after my decease

I give and devise All my real Estate whatsoever and wheresoever unto my Friends Andrew Shipman of Eaton in the said County of Leicester Farmer and Thomas Shipman of Croxton Kerrial in the said County of Leicester Farmer their heirs executors administrators and assigns Upon the Trusts after mentioned

And as to for and concerning the rest residue and remainder of my personal Estate and Effects whatsoever and wheresoever I give and bequeath the same unto the said Andrew Shipman and Thomas Shipman their executors administrators and assigns Upon Trust that they the said Andrew Shipman and Thomas Shipman and the Survivor of them her executors and administrators do and shall as soon as conveniently may be after my decease convert into Money so much thereof as shall not consist of Money or Securities for Money and collect get in and receive the residue thereof And do and shall lay out and invest the same in their or his names or name in the Public Funds of Great Britain or at Interest upon real Securities in England And from time to time to alter vary and transfer the said Trust monies for or unto other Funds or Securities of the like nature when and as often as they or he shall think fit And do and shall permit and suffer my Wife Eleanor to receive the Interest arising from the said Trust Monies as well as the rents of my said real Estate for and during the term of her natural life if she shall so long continue my Widow And after the decease of my said Wife in case she shall continue my Widow

Upon Trust that they the said Andrew Shipman and Thomas Shipman and the Survivor of them his executors and administrators do and shall pay the sum of Two hundred pounds unto my Cousin Richard Taylor of Gunby in the County of Lincoln if he shall be then living But in case he shall be dead then to divide the same sum equally between such of his Children as shall be living at the decease of my said Wife

And also do and shall pay the sum of Two hundred pounds unto between and amongst such of the Children of John Bell of Coston Jobber by his second Wife Elizabeth Frasby as shall be living at the decease of my said Wife share and share alike

And upon further Trust to pay and transfer the residue of my said real and personal Estate Unto such person or persons and in such manner as my said Wife shall by her last Will and Testament give devise and bequeath the same

But in case my said Wife shall marry again Then Upon Trust that they the said Andrew Shipman and Thomas Shipman and the survivor of them his executors and administrators do and shall pay to her the sum of Four hundred pounds within six Calendar Months after her marriage

And do and shall stand possessed of the residue of my said real and personal Estate Upon the Trusts after mentioned that is to say As to my said real Estate to sell the same by public Auction or private contract for the most money that can be had or gotten for the same and convey the same to the purchaser or purchasers thereof

And as to my said personal Estate to convert the same into Money And pay and apply the Money arising from my said real and personal Estate in manner following that is to say

One undivided moiety or equal half part thereof unto my said Cousin Richard Taylor if he shall be living at the time of my said Wifes marriage And if he shall be dead Then to such of his Children as shall be living at the time of such marriage share and share alike

And the remaining undivided moiety or equal half part thereof Unto such of the Children of the said John Bell by his said second Wife Elizabeth Frasby as shall be living at the time of my said Wifes Marriage share and share alike

Provided Always and I hereby declare that the receipt of the said Andrew Shipman and Thomas Shipman and the survivor of them his heirs executors administrators and assigns shall be a good discharge for all monies which in such receipt shall be expressed to be received And that all persons paying any monies to them or him for the purposes of this my Will and taking a receipt for the same shall not be obliged to see to the further application of the same Monies nor be accountable for the misapplication thereof

And lastly I appoint my said Wife Eleanor Taylor Sole Executrix of this my Will

Eleanor Taylor of Stathern in the County of Leicester Widow the sole Executrix in this Will named was duly sworn to the Truth and faithful performance thereof as usual and that the Goods Chattels and Credits of the deceased do not amount in value to the sum of Eight hundred pounds and that the deceased died on the 3d day of January One thousand eight hundred and forty seven

On the thirtieth day of August 1847 original Will exhibited before the Reverend Jemson Davies Clerk Master of Arts and Surrogate of the Commissary and Probate decreed to pass the Seal to the above named Eleanor Taylor the sole Executrix in the presence of
