John Smith of Long Clawson 1726 Will and Inventory

In the Name of God Amen I John Smith of Claxton als Long Clawson in the County of Leicester yeom being in health of body and of Sound and perfect mind and Understanding praised be Almighty God for the Same but considering the Uncertainty of this life and the certainty of death do make and ordain this my last Will and testament in manner and forme following (that is to say)

Impris I resign my Soul into the hands of Almighty God my Creator and my body I committ to the earth to be decently buried at the discretion of my executors herein after named and as for my temporal estate which it hath pleased God to bestow upon me I give devise and bequeath the Same as followes viz

I give and devise all my Lands tenements and hereditamts lying and being within the Lordship and precincts of Claxton als Long Clawson aforesaid Unto my Son Richard Smith his heires and assignes for ever

Item I give and devise all that my three quarters of an oxgang of Land lying and being dispersedly within the Several fields libties and precincts of Nether Broughton aforesaid [sic] which I lately purchased to me and my heires of and from one Mrs Wotton and is now in the possession of Richard Wright Unto my Son Andrew Smith his heires and assignes for ever

Item all the Rest and Residue of my Lands tenements and hereditaments whatsoever with their and every of their appurtenances Situate lying and being within the Lordshipp and prescincts of Nether Broughton aforesaid I give devise and bequeath Unto my Son John Smith and his heires

Subject nevertheless to the payment of the Sum of three hundred pounds and Interest for the Same which I owe to Mr James Allen upon Mortgage

And also to the payment of the further Sum of fifty pounds which I hereby give and bequeath Unto my daughter Mary Smith to be paid to her when she attaines to her full age or Two and twenty years

And also Subject to the payment of the further Sum of Thirty pounds which I hereby give and bequeath Unto my daughter Rebecca Smith to be paid to her when She Shall Attain to her full age of one and twenty years And my Will and mind is that if either of my Said daughters shall happen to dye before they Attain to their Said respective ages aforesd that the legacy or porcon of Such of them So dying Shall go Unto the Survivor of them

And I do hereby Charge all my aforesaid Lands tenements and heredittaments whatsoever So given Unto my Said Son John Smith and his heires with the payment of the Said Sum of three hundred pounds and Interest due Unto the said Mr James Allen And also with the payment of the Said two Several Sums of fifty pounds and thirty pounds So given Unto my Said two daughters Mary and Rebecca as aforesaid

Yet nevertheless it is my express Will and mind that my dear and loving Wife Rebeccah Shall receive the Rents issues and profitts of all and Singular my aforesaid Lands tenements and hereditaments So given Unto my Said three Sons Richard Andrew and John Smith Untill they shall attain to their several and respective ages of one and twenty years to enable her to pay and discharge the Interest for the Said three hundred pounds due Unto the Said Mr Allen from time to time as the Same Shall grow due and payable And also to enable her to bring up all my Said Sons and daughters Until they shall Attain their Said respective ages of one and twenty years

Item all the Rest of my Goods Cattle Chattles and personal estate whatsoever my debts legacies and funeral expences being first thereout paid and discharged I give and bequeath Unto my Said loving wife Rebeccah and my Said Son John Smith whom I hereby appoint full and joynt executors of this my Will hereby revoking all former Wills by me made declaring this to be my last Will and testament

In Witness whereof I the Said John Smith the testator have hereunto Set my hand and Seal this Sixth day of December in the thirteenth year of the Reign of our Soveraign Lord George now king of Great Britain & Anno dni 1726
