Henry Smith of Nether Broughton 1895 Will

This is the Last Will and Testament of me Henry Smith of Nether Broughton in the County of Leicester Grazier

I hereby revoke all former Wills made by me

I appoint my Son Edgar William Smith, now residing at Derby, sole Executor and Trustee of this my Will

After payment of my just debts and funeral and testamentary expenses I devise my house land and hereditaments situated at Nether Broughton unto and to the use of my said Trustee his heirs and assigns in Trust to permit my Wife Louisa Smith so long as she shall continue my Widow and think fit to dwell in the same to have the use of the said house, lands and hereditaments she maintaining and keeping the same during her residence there in good and tenantable repaid and condition to the satisfaction of the Trustee or Trustees for the time being

I desire that my Son Thomas Henry Smith of Nether Broughton shall have his home in the said house so long as it is occupied by may said Wife and he conducts himself to her satisfaction and desires to reside there

I bequeath to my said Wife Louisa Smith all the ready money liquors fuel housekeeping stores or provisions which shall at my death be in and about my dwellinghouse to be delivered to her immediately after my death

I bequeath all my household furniture and other effects of a like nature, also my cattle and all farming stock and implements together with my stock in trade to my said Trustee upon Trust to permit my Wife Louisa Smith to have the personal use and enjoyment thereof during her life or as long as she continues my Widow And should my said Wife Louisa Smith still being my Widow desire to reside elsewhere or for any other sufficient reason request it I give to my said Trustee power to let the said House lands and hereditaments or part thereof and to pay the Annual Income from such letting to my said Wife as long as she continues my Widow and also to sell the farming stock and implements and invest the proceeds in some good and safe security and to pay the interest thereof to may said Wife and to my son Thomas Henry Smith in equal shares during the lifetime of the said Louisa Smith or as long as she continues my Widow

At the death or remarriage of my said Wife Louisa Smith I desire my said Trustee to sell and convert into money my house lands and hereditaments at Nether Broughton and my household furniture farming stock and other effects and divide the proceeds together with all my residuary estate, in five equal shares two shares to be paid to my Son John Frederick Smith of Demarara and two shares to my said son Edgar William Smith and one share to be paid to my said son Thomas Henry Smith

In witness whereof I have hereunto set my hand this 29th day of November 1893

Signed by the said Testator as his last Will and Testament in the presence of us both present at the same time who at his request in his presence and in the presence of each other have hereunto subscribed our names as witnesses
