Thomas Rouse of Hose 1851 Will

The last will and Testament of me Thomas Rouse of Hose in the parish of Hose and County of Leicester being weak in body but of sound and disposing memory and understanding

First I commend my Soul into the hands of Almighty God who gave it and my body I commit to the earth to be decently interred at the discretion of my Executrix hereinafter named, and all my worldly estate whatsoever and wheresoever being all personal I give and bequeath the same after payment of my funeral expences the expence of proving this my will and all my just debts as hereinafter mentioned

First I give and bequeath unto my Wife Elizabeth £4 per year for pocket money and her maintenance so long as they can agreed to live together, should it so happen that they cannot agree to live together and she has to leave I give and bequeath her £12 per year during her life

Also I give to my Sons James, Henry, and Thomas £10 each Should they return to England

And lastly I give to my Daughter Ann Rouse her Executors Administrators and assigns all the rest residue and remainder of my estate whatsoever and wheresoever the same may be and not hereinbefore given and disposed of to and for her and their own benefit and use and I do hereby appoint my said daughter Ann Rouse Sole Executrix of this my last will and Testament hereby revoking all former and other wills and Testaments by me at any time heretofore made

Should they not be allowed to continue in the Farm all the goods chattles stock and implements to be sold by Auction and the money to be distributed as hereafter mentioned

To my Wife Elizabeth one third part to my Daughter one third part and to my three Sons one third part to be divided equal betwixt James, Henry, and Thomas, when they return to England

In witness whereof I set my hand this 14th day of November in the year of our Lord 1850

Ann Rouse of the Parish of Hose in the County of Leicester Spinster The sole executrix in this will named was duly sworn to the truth and faithful performance thereof as usual and that the goods chattels and credits of the deceased do not amount in value to the sum of three hundred pounds (£300) and that the deceased died on the 11th day of January last past

On the 6th day of June 1851 Original Will & Affidavit Exhibited before the Revd Charles Mortlock Clerk Bachelor of Arts and Surrogate and Probate decreed to pass Seal to the above named Anne Rouse the sole executrix in the presence of

In the Court of the Commissary of the Lord Bishop of Lincoln in and for the Archdeaconry of Leicester Appeared personally Thomas Huckerby of the Parish of Hose in the County of Leicester Publican and made oath that he is one of the subscribed witnesses to the last will and Testament of Thomas Rouse late of Hose in the County and Archdeaconry of Leicester Farmer deceased bearing date the fourteenth of November in the year of our Lord one thousand eight hundred and fifty now hereunto annexed and marked with the letter A and he further made oath that on the fourteenth day of November aforesaid the Testator duly executed his said last will by making his mark at the foot or end thereof in the presence of this Deponent and of Leonard Gibson of the Parish of Hose Bricklayer the other subscribed Witness thereto who were then together present at the same time with the said deceased And this Deponent and the said Leonard Gibson of the said Parish of Hose thereupon attested and subscribed the said Will in the presence of the said Testator and of each other

On the 3d day of June in the year of our Lord One thousand eight hundred and fifty one the said Thomas Huckerby was July sworn at Scalford in the County and Archdeaconry of Leicester to the truth of the aforegoing Affidavit
