Benjamin Philpotts of Hose 1928 Will

This is the last Will and Testament of me Benjamin Philpotts of Hose in the County of Leicester Retired Foreman Platelayer I revoke all Wills and Testamentary dispositions heretofore made by me

I appoint my friends Walter Stubbs of Hose aforesaid Corn Merchant and Grazier and Eustace Rushworth Burnett of Hose aforesaid Grazier to be the Executors and Trustees of this my Will

I direct that my funeral and testamentary expenses and debts shall be paid out of my personal estate

I bequeath to my Grandson Benjamin Philpotts the son of James Huckerby Philpotts my silver watch

I bequeath to the said James Huckerby Philpotts of 32 Rydall Street Holbeck Leeds Foreman Shunter my best Dining Table A Chest of Drawers One Feather Bed One Wash stand A Grand Father’s Clock A Work Box and a pair of Candle sticks

I bequeath to my Granddaughter Frances Ethel Philpotts the daughter of Tom Philpotts A Clock and Glass case

I bequeath to the said Tom Philpotts of 2 Castle View Stafford Railway Fitter A rocking Chair for the use of his Wife A small Leaf Table in the kitchen Three corner Cupboard in the Kitchen A large Feather Bed A Bed Warming Pan and a Wash Stand

And I bequeath the residue and remainder of my Personal estate of whatsoever nature or kind and wheresoever situate to my two before mentioned Sons James Huckerby Philpotts and Tom Philpotts in equal shares and in case there is any dispute over or concerning the division of the same my said Executors or such Executor as may be then alive shall finally settle the same

I devise all my Real estate of whatsoever nature or kind and wheresoever situate to my two said sons James Huckerby Philpotts and Tom Philpotts as tenants in Common in equal shares and not as Joint Tenants And I make no direction for the sale of my said Real Estate so that the matter is entirely in the discretion of my said two sons

In witness whereof I the Testator have hereunto set my hand this eighteenth day of July One thousand nine hundred and twenty two
