Henry Newby of Ab Kettleby 1756 Will

In the name of God Amen I Henry Newby of Ab Kettleby in the County of Leicester Clerk being Somewhat infirm in body but of Sound and disposing mind memory and understanding praised be Almighty God for the Same do make and Ordain this my last Will and Testament in manner and forme following That is to Say

First I give devise and bequeath unto John Cave Brown of Stretton in the Fields in the  County of Derby Esquire and his heirs All that my right of Presentation in and to the Church and Vicarage of Ab Kettleby and Holwell in the said County of Leicester now in my Own possession Together with all the rights priviledges and Appurtenances thereunto belonging and Appertaining and under what denomination the Same Shall be called or known In trust that he or they do as soon as Conveniently may be after my decease Sell and dispose of the Same for the best price that can be had or got And the money Arising by such sale I will shall be applyed in manner hereinafter menconed

Also I give and bequeath unto the said John Cave Brown All my Goods Chattles Cattle Creditts and personall Estate whatsoever In trust that he do also immediately after my decease sell and dispose of the said Goods and Chattles and the money Arising by sale thereof together with the money above menconed I will shall be Applied as follows

First to pay and discharge all my funerall expences And also all the charges & Expences that the said John Cave Brown Shall be at and Sustain in the Execucon of the Trust herein reposed in him by this my Will And after the charges and Expences above menconed are paid and satisfied Then I will he the said John Cave Brown do also pay and discharge all my just debts which I owe upon Specialties and Simple contracts And after my said debts are paid and satisfied then I give the remainder to be divided into five Equal and distinct shares and parts to the several persons following That is to say

To my Nephew and Godson Charles Allsopp one fifth part or share

To my Nephew and Godson Henry Parnell one other fifth part or share

To my Nephews Henry Newby and John Newby to be Equally divided between them one other fifth part or share

To my Nephew William Simpson one other fifth part or share

And the remaining fifth part of share to my Particular friend Mrs Lois Jones Spinster

I do hereby Nominate and Appoint the said John Cave Brown full and Sole Executor of this my last Will and Testament hereby revokeing all former Will and Wills by me at any time heretofore made declaring this to be my last Will and testament

In Witness whereof I the said Henry Newby the Testator have to this my last will and Testament put my hand and Seal this Fifteenth day of February in the year of our Lord One thousand seven hundred and fifty six
