This is the last Will and Testament of me Joshua Marriott of the Parish of Stathern in the County of Leicester Farmer

First I will that my just debts funeral and Testamentary expenses be paid

I Give and bequeath unto my Children John Marriott, James Marriott, Sarah Wall, Mary Sidney, Ann Jackson and Elizabeth Marriott the Sum of Nineteen Pounds nineteen shillings each the aforesaid legacies to be paid by my Executor hereinafter named within six calendar months after the decease of my Wife Ann Marriott and in case any of my aforesaid Children shall happen to die before the said legacies shall be payable, Then I Give and bequeath the share or shares of him, her or them so dying as aforesaid unto their Issue but should him, her, or them so dying without Issue then I will that the share or shares of him her or them so dying be equally divided amongst my Children that shall then be living and should any of my Children remain unmarried Then I will that he her or them have a home so long as they continue unmarried

I Give and bequeath unto my affectionate Wife Ann Marriott all my Freehold Land containing Fifteen Acres or thereabouts (more or less) and appurtenances thereunto belonging situate in the Parish of Stathern aforesaid in the said County and now in my occupation and also my Household Furniture, Plate, Linen and China and also my Live Stock and Farming Implements to have the use and occupation of my aforesaid real Estate and personal effects thereof for and during the term of her natural life

And after her decease I Give and bequeath my best Chamber Bed and all belonging to the said Bed unto my aforesaid Daughter Elizabeth Marriott and also after my said Wife’s decease I Give and bequeath the Bed now in my Parlour and all belonging to the said Bed unto my aforesaid son James Marriott

I Give and bequeath after the decease of my said Wife Ann Marriott the aforesaid Freehold Land and residue and remainder of my estate and effects whatsoever and wheresoever and of what nature or kind soever not hereinbefore disposed of, after payment of all my just debts, funeral and testamentary expenses and the aforesaid legacies unto my Eldest son William Marriott his Heirs Executors and Administrators absolutely for ever and I also nominate constitute and appoint my said son William Marriott Executor of this my last Will and Testament and I do hereby revoke and make void all former Wills by me at any time heretofore made I do declare this to be my last Will and Testament

In Witness whereof I Joshua Marriott the Testator have to this my last Will and Testament set my hand and seal this Twenty third Day of November In the year of Our Lord One Thousand Eight Hundred and forty one

Signed, sealed, published and declared by the said Testator Joshua Marriott as and for his last Will and Testament in the presence of us who at his request and in his presence have signed our Names as Witnesses to the same

In the Court of the Commissary of the Lord Bishop of Leicester for the Archdeaconry of Leicester Appeared personally Nathaniel Kemm of Eaton in the county of Leicester Schoolmaster and made oath that he is one of the subscribed witnesses to the last will and Testament of Joshua Marriott late of the Parish of Stathern in the County and Archdeaconry of Leicester Farmer deceased bearing date the twenty third day of November one thousand eight hundred and forty one now hereunto annexed and marked with the letter (A) and he further made oath that on the twenty third day of November aforesaid the Testator duly executed his said last will by signing his Name at the foot or  end thereof and sealing publishing and declaring the same as his Will in the presence of this Deponent, and of Robert Pyzer of Stathern aforesaid Cottager and Thomas Doubleday of Stathern aforesaid Bricklayer the other subscribed Witnesses thereto who were then together present at the same time with the said deceased And this Deponent and the said Robert Pyzer and Thomas Doubleday thereupon attested and subscribed the said Will in the presence of the said Testator and of each other

On the twenty fifth day of October in the year of our Lord One Thousand eight hundred and forty two the said Nathaniel Kemm was sworn at Melton Mowbray in the County and Archdeaconry of Leicester to the truth of the aforegoing Affidavit

                                                                                                         Before me RF Croughton Surrogate to the Commissary

William Marriot of Stathern Farmer and Grazier Sole Executor in this will named was duly sworn to the truth and faithful performance thereof as usual and that the goods Chattels and credits of the deceased without deducting any debts owing therefrom do not amount in value to the sum of one hundred pounds and that the deceased died on the sixth day of December last past
