Thomas Kirk of Plungar 1866 Will

This is the last Will and Testament and Testament of me Thomas Kirk of Plungar in the County of Leicester Farmer

I direct my Executors to pay and discharge all my just debts funeral and testamentary expenses as soon as conveniently may be after my decease

I Give and bequeath all my Estate and Effects whatsoever and wheresoever unto my two Sons Thomas Kirk and William Kirk Upon Trust to permit and suffer my Wife Sarah Kirk to have the use and benefit thereof for and during her life and upon her decease I Give and bequeath unto my daughter Mary the Wife of John Bates of Whatton in the County of Nottingham Shopkeeper a Legacy or sum of One hundred pounds over and above and in addition to the sum of One hundred pounds now owing by her or her husband to me and I give and bequeath unto George Caunt Elizabeth Worthington and Sarah Duffin the children of my present Wife my her former Husband a Legacy or sum of Twenty pounds each and I direct that all the said Legacies shall be paid by my Executors within twelve calendar months after the decease of my said Wife and after payment thereof I Give and bequeath all my residuary estate and effects whatsoever and wheresoever unto my said two Sons Thomas Kirk and William Kirk equally to be divided between them share and share alike and to their respective executors administrators and assigns

I devise all lands and hereditaments which shall at my decease be vested in me as Mortgagee or Trustee in fee or otherwise Unto and to the use of my said two Sons Thomas Kirk and William Kirk their heirs executors administrators and assigns subject to the trusts and equities affecting the same respectively and to the purposes of this my Will I appoint my said two Sons Thomas Kirk and William Kirk joint Executors of this my Will and declare that they shall be chargeable only to the extent of their respective actual receipts and be exempt from responsibility for involuntary losses and be entitled to retain all disbursements and expenses incident to the execution of the trusts of this my Will

In Witness whereof I have hereunto set my hand this eleventh day of March in the year One thousand eight hundred and fifty nine

The Testator Thomas Kirk was late of Plungar in the County of Leicester Farmer and died on the Fourteenth day of February 1866 at Plungar aforesaid
