Robert Hardy of Hickling 1846 Will and Probate

In the Exchequer Court of York Probate of the Will of Robt Hardy Farmer &c decd Dated 17th March 1846

This is the last Will and Testament of me Robert Hardy of Hickling in the County of Nottingham Farmer and Butcher

I direct the payment of my just debts and funeral and testamentary expenses as soon as conveniently may be after my decease

I give and devise all that my Close or Parcel of Land situate in Hickling aforesaid called the Bride Gate Close containing about nine acres and now in the my own occupation and which was the estate of my late Father or Mother unto and to the use of my son John his heirs and assigns for ever

I also give to my said son John the sum of six hundred pounds but I direct that he shall not enter into possession of the said Close or receive the said Legacy until he attains the age of twenty one years

I give devise and bequeath all the rest and residue of my Real Estate and also all my personal estate whatsoever and wheresoever unto my Wife Ann and my son Robert and to the heirs executors administrators and assigns of my son Robert for ever But in case my said Wife shall marry again her Life Estate and interest in my said Real and personal Estates shall cease and the whole devolve on my said son Robert his heirs executors administrators or assigns Subject nevertheless and I do hereby expressly charge the residue of my said Real Estate hereinbefore devised to my said Wife and son Robert as aforesaid with the maintenance and support of my said son John during his minority and also with the maintenance of my brother John in a proper and reasonable manner so long as he shall think well to reside with my said Wife and son or the survivor of them but in case he shall be desirous to reside elsewhere then that he shall be allowed and paid the sum of Thirty pounds a year which sum I direct shall be paid by four equal quarterly payments in each year and also subject and chargeable with and to the payment of the Legacy hereinbefore given to my said son John on his attaining the age of Twenty one years and with and to the payment of the following legacies namely

I give to my daughters Ann Jane and Hannah the sum of Four hundred pounds each which Legacies I direct shall be paid as and when they respectively attain the age of twenty five years with lawful interest upon their said legacies from my decease until payment such interest to be paid half yearly provided such time for payment shall not happen sooner than twelve calendar months next after my decease as in case of such time so happening payment (with interest) shall be postponed until the end of such twelve months provided also that in case all or any of my said Daughters shall have attained the age of twenty five years at the time of my death then I direct that the Legacies of such daughters shall be payable in twelve months after my decease with interest thereon from my death until payment and I do direct that in case my said son John shall die under the age of twenty one or any of my said daughters shall die under the age of twenty five leaving lawful issue of his her or their body or bodies then such issue shall have and take their respective parents estate interest legacy given by this my Will equally if more than one And in case of any such death without leaving lawful issue as aforesaid the Estate interest legacy share or shares as well original as accruing by survivorship of him her or them so dying shall go equally amongst or unto the survivors or survivor of them my said children Robert John Ann Jane and Hannah

And I do nominate and appoint my said Wife and son Robert Executrix and Executor jointly of this my Will and they and the survivor of them Guardians and Guardian of my said son John during his minority

In Witness whereof I the said Testator Robert Hardy have to this my last Will and Testament set my hand this seventh day of March one thousand eight hundred and thirty eight

Appeared personally William Wise of the Town of Nottingham Gentleman and made oath that he is one of the subscribed Witnesses to the last Will and Testament of Robert Hardy late of Hickling in the County of Nottingham Farmer and Butcher deceased bearing date the seventh day of March one thousand eight hundred and thirty eight hereunto annexed and he further made oath that on the seventh day of March aforesaid the said Robert Hardy duly executed the said Will by writing his name at the foot or end thereof in the presence of this Deponent and of William Howard Wise the other subscribing Witness thereto both of whom were present at the same time and this deponent and the said William Howard Wise thereupon attested and subscribed the said Will in the presence of the said Testator and of each other
