In the name of God Amen This is the last Will and Testament of me William Hanbury of Claxton otherwise Long Clawson in the County of Leicester Grazier

First I give and devise All and every of my Messuages Lands Hereditaments and real Estate whatsoever situate and being in Claxton otherwise Long Clawson aforesaid Unto my two friends Samuel Fisher of Whatton in the County of Nottingham Grazier and Robert Goodacre of Claxton otherwise Long Clawson aforesaid Schoolmaster their Executors Administrator and Assigns from the day of my decease for and during and unto the full end and term of five hundred years from thence next ensuing and fully to be completed and ended without impeachment of or for any manner of waste Upon such Trusts nevertheless to and for such uses intents and purposes and under and subject to such powers and provisoes as are hereinafter mentioned and declared of and concerning the same

And from and immediately after the end expiration or other sooner determination of the same term And in the meantime subject thereto I Give and devise All my said Messuages Lands and real Estate Unto my own right Heirs forever And I do hereby expressly declare that the said Messuages Lands and real Estate hereinbefore limitted to the said Samuel Fisher and Robert Goodacre and their Executors Administrators and Assigns for the said term of five hundred years is and are so limitted to them Upon the Trusts and to and for the intents and purpose hereinafter mentioned and declared of and concerning the same

That is to say upon Trust that the said Samuel Fisher and Robert Goodacre and the Survivor of them and the Executors Administrators and Assigns of such survivor Do and shall by Sale or Mortgage of the Messuages Lands and real Estate comprised in the said term of five hundred years or of a competent part thereof for all or any part of the said term raise and levy the sum of five pounds apiece for them my said Trustees as a recompence for the trust hereby respectively reposed in them And also to raise and levy in like manner such sum and sums of Money as will enable them my said Trustees to pay and discharge all my just debts of what kind soever my Funeral and Testamentary expences and the sum of twenty pounds which I hereby give to Frances Wrighten my late Wifes Sister

And also Upon the further Trust to raise and levy by virtue of the Trusts of the said term of five hundred years such sum or sums of Money as will enable my said Trustees or the Survivour of them his Executors Administrators or Assigns to pay my natural son Thomas Hanbury otherwise Thomas Swain the sum of one hundred pounds which I hereby give and bequeath to him in case he be living at my decease or in case he be then dead and has left lawful Issue then I give the same to such Issue in equal shares and I do hereby declare my Will to be that my said Trustees or Trustee for the Time being shall raise and levy the said sum of one hundred pounds within six calendar Months next after my decease yet my mind and Will is that my said Trustees or Trustee for the time being shall place the same out at interest and receive and take the interest as it becomes due and pay such interest to him so long as he shall continue in the Army or shall be employed in such businesses only as they shall think requires no money to carry them on with profit to him but in case my said Trustees or Trustee for the time being shall at any time think my said son will make that good use of the said principal sum or Legacy of one hundred pounds which I intend he should by using it prudently my will is that they shall pay it to him at his or their discretion

And I do hereby will and direct that it shall be lawful to and for my said Trustees or Trustee for the time being by virtue of the said term of five hundred years to raise and levy in like manner as aforesaid on my said real Estate such further sum of sums of Money as will reimburse himself and themselves all such reasonable expences as he or they shall sustain or be put to in the execution of this my Will

And I give and bequeath to my said late Wifes Sister Frances Wrighten All my Goods Chattels Cattle and personal Estate whatsoever (Except my ready Money securities for Money and such sums of money as shall be owing to me at the time of my decease) to be delivered to her within one Month after my decease

And my ready Money securities for money and such sums of Money as shall be owing to me I direct my said Trustees to apply towards the discharge of my just debts And I do hereby will and direct that the Receipt and Receipts of the said Samuel Fisher and the said Robert Goodacre and the Survivour of them his Executors Administrators or Assigns signed by him or them shall be a good and sufficient discharge and discharges to the person or persons who shall so advance and lend the sum or sums of Money to be raised and levied by virtue of the said term of five hundred years or any part thereof for so much thereof for which such Receipt or Receipts shall be so given and that after the giving and signing such Receipt or Receipts such person or persons shall not be answerable or accountable for any loss misapplication or nonapplication of any part thereof And also that any said Trustees and Executors and Administrators and their respective Executors and Administrators shall be charged and chargeable only each and every of them for and with his and their respective Receipts and payments acts and wilful defaults and not otherwise and shall not be chargeable with or for any sum or sums other than such as shall actually and respectively come to his or their hands by virtue of this my Will nor with nor for any loss or damage which may happen in or about the Execution of the Trusts herein reposed in them without his or their wilful default or neglect

Lastly I do hereby make and ordain the said Samuel Fisher and Robert Goodacre joint Executors in Trust of this my last Will and Testament hereby revoking all former Wills by me made ratifying and declaring this and none other to be last Will and Testament

In Witness whereof I the said William Hanbury the Testator have to this my said last Will and Testament set my hand and seal this twenty second day of October in the year of our Lord One thousand eight hundred and ten

Nov 19 1811 Let probat be granted to Samuel Fisher Grazier of Whatton & Robert Goodacre School master of Long Clawson the joint Executors of this will: they being sworn to the due Execution thereof & made oath that the whole personal Estate of the Testator at the time of his death (November 16th 1811) not including debts did not amount to the sum of One hundred Pounds
