This is the last Will and Testament of me Thomas Hall of Stathern in the county of Leicester Carrier and Grazier

I appoint my Wife Elizabeth Hall and my Friend George Hardy of Stathern aforesaid Tailor (who are hereinafter called my Trustees) to be the Executors and Trustees of this my Will

I bequeath to my said Wife during her life the use and enjoyment of all my Household Furniture and effects and after her decease I direct the same Household Furniture and effects to sink into and form part of my residuary Personal Estate And I declare that it shall not be necessary for my Trustees to cause any Inventory to be made of the same Household Furniture and effects before the delivery thereof to my said Wife and that they shall not be responsible for any loss or injury which may happen thereto during the time the same shall be in her possession

I bequeath all my Personal Estate and Effects not hereby otherwise disposed of to my Trustees Upon trust that my Trustees shall sell call in and convert the same into money or such part thereof as shall not consist of money and shall out of the moneys produced thereby and out of my ready money pay my Funeral and Testamentary expenses and debts and shall invest the net residue of the said moneys upon any of the Stocks Funds or Securities authorised by law for the investment of Trust moneys with power to vary the same at their discretion and shall stand possessed of the said residuary Trust moneys and investments (hereinafter called “the said Trust fund”) Upon Trust to pay the income thereof to my said Wife during her life and on her decease Upon Trust to pay out of the said Trust fund a Legacy of Three pounds to such of my following Children as shall be then living namely my sons George, William, Thomas, James and Henry and my Daughters Mary Ann Hempshall, Betsy Clarke and Sarah Wright

To my youngest Daughter Harriett Tyers a Legacy of Forty pounds and Upon further Trust to pay the net residue of the said Trust fund to my youngest son Joseph Hall to whom I give the same absolutely Provided always that if either of my said Children Harriett Tyres and Joseph Hall shall die in my lifetime leaving a child or children who shall be living at the time appointed for the payment of the said Legacy and net residue of the said Trust fund then and in every such case such last mentioned Child or Children shall take and if more than one equally between them the said Legacy and net residue of the said Trust fund which his her or their parent would have taken under this my Will if such parent had been living at the death of my said Wife

I declare that my Trustees may postpone the sale calling in and conversion of my residuary personal estate or any part thereof during the life of my said Wife or for any less period and that the profits and income to accrue from and after my decease of and from such part of my same residuary personal estate as shall for the time being remain unsold and unconverted shall after payment thereout of all incidental expenses and outgoings be paid and applied to the person or persons and in the manner to whom and in which the income of the monies produced by such sale and conversion would for the time being be payable or applicable under this my Will if such sale and conversion had been actually made

And I further declare that my Trustees may if they shall think fit so to do during the life of my said wife or for any less period carry on the business of a Grazier and Carrier now carried on by me and employ therein the whole or such part or parts of my residuary Personal estate as they may think fit and the profits arising from the carrying on of the said business shall be deemed to be income arising from my residuary Personal Estate and be paid and applied accordingly

And I authorise my Trustees to do and execute all such acts and things in relation to the carrying on of the said business as may appear to them necessary or expedient without being answerable for any loss which may arise thereby

Signed by the said Thomas Hall the Testator as and for his last Will and Testament in the presence of us present at the same time who in his presence at this request and in the presence of each other have hereunto subscribed our names as attesting Witnesses the words “sell” on the first page and “Wife” on the third page having been first interlined and the words “duty free” erased with a pen And we certify that the above Will was read over to the said Testator in our presence and that he seemed perfectly to understand the same

This is a Codicil to the above written Will of me the above named Thomas Hall

I revoke the Legacies of Three pounds each to my Children George, William, Thomas, James, Henry, Mary Ann Hempstall, Betsy Clarke and Sarah Wright and I reduce the Legacy of Forty pounds given to my Daughter Harriett Tyres to the sum of Twenty pounds

I appoint my friend William Jackson of Eastwell in the county of Leicester Farmer an Executor and Trustee of my said Will in addition to my said Wife and my friend George Hardy and subject to these alterations I confirm my said Will

Witness my hand 18th day of February 1891

Signed and declared by the above named Testator Thomas Hall as a Codicil to his last Will in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as Witnesses

And we certify that the above Codicil was read over to the said Testator before the execution thereof by him and that he seemed to understand the contents thereof

Proved at Leicester with a Codicil on the fifth day of May 1891 by the Oaths of Elizabeth Hall Widow the Relict and George Hardy the Executors named in the Will and William Jackson the Executor in the said Codicil to whom Administration was granted

The Testator and Thomas Hall was late of Stathern in the County of Leicester Carrier and Grazier and died on the nineteenth day of February 1891 at Stathern aforesaid

Personal Estate Gross £290.  No deduction.
