Mary Guy of Ab Kettleby 1786 Will

In the Name of God Amen I Mary Guy of Ab Kettleby in the County of Leicester Widow being of sound mind and memory Do make and Ordain this my last Will and Testament in form and manner following (That is to say)

First I desire to be decently buried at the discretion of my Executor afternamed And as touching my worldly Estate and Effects wherewith it hath pleased God to bless me in this Life I dispose of them as follows (That is to say)

First I give and devise All my Closes or Pieces or Parcels of Lands with every of their Appurtenances lying and being in the New Inclosed parts of the Liberty of Claxton otherwise Long Clawson in the said County of Leicester to my son Andrew Guy his Heirs and Assigns for ever Subject nevertheless with or to the following yearly and other payments (That is to say)

First I will and direct that my said son Andrew Guy & his Heirs and Assigns shall pay One Annuity of Five Pounds a year yearly and every year out of the Rents and Profits of my said Lands and Premises and likewise that he my said son Andrew Guy or his Executors or Administrators shall apply the said Annuity of five Pounds a year towards maintaining clothing and educating my Grandson Andrew Guy and my Grandaughter Melicent Guy untill the younger of them shall have attained to the age of Seventeen Years and in case either of them shall happen to die before the younger of them shall have attained that age then I will and direct that my said son Andrew Guy his Heirs or Assigns shall pay the said Annuity of five Pounds a year out of the Rents and Profits of my said Lands and premises and that my said son Andrew Guy or his Executors or Administrators shall likewise apply the said Annuity towards maintaining clothing and educating the Survivor of my said Grand children untill such Survivour shall have attained to the age of Seventeen Years provided nevertheless my mind and will is that if my said son Andrew Guy will keep and maintain my said Grandson and Grandaughter or the Survivour of them with his own Family it shall be lawful for him to apply so much of the said Annuity as shall become due during the time he shall so maintain and keep them or the Survivour of them to his own proper use And when and as soon as the younger of the Survivour of my said Grand Children shall have attained to the age aforesaid or at the Decease of the longer liver of them in case they both happen to die before they attain that age Then I will and direct that my said son Andrew Guy & his heirs and Assigns shall pay the said Annuity of five Pounds a Year out of the Rents and profits of my said Lands and premises to my son Edward Guy during the Term of his natural Life by equal half yearly payments on the fifth Day of April and Tenth Day of October in every year the first payment thereof to be made on the first of the said Days of payment as shall first and next happen after the said Annuity shall become payable to my said son Edward Guy and shall so continue to be made half yearly during his natural Life

Also I give and bequeath to my said Grandson Andrew Guy and my said Grandaughter Melicent Guy the sum of Twenty Pounds apiece to be paid to each of them at the Decease of my said son Edward Guy but in case my said son Edward Guy should happen to die before they attain to their respective ages of Twenty two Years then I will and direct that the said Legacies of Twenty Pounds apiece shall be paid to them at the time they attain their respective ages of Twenty two years and I do hereby charge all my said Lands and premises with the payment of the said Legacies to my said Grandchildren as well as with the payment of the aforementioned Annuity And in order that true payment may be  made according to the meaning of this my Will I further will and direct that in case any default shall be made in the payment or application of the said Annuity of five pounds a year or of the said Legacies aforementioned to my said Grand Children at the times and in manner aforesaid or in payment of the Interest of the money for which my said Lands and premises now are or may be mortgaged yearly as the same become due that then it shall and may be lawful to and for William Wilford of Scalford in the said County of Leicester Grazier and John Adams of Wartnaby in the said County Grazier whom I do make and appoint Trustees of this my last Will and Testament to see the same duly preformed or the Survivour of them or the Heirs of such Survivour to enter into the possession of all and singular my said Lands and premises and to let and set the same and receive and take the Rents and Profits thereof as they become due and to apply them towards paying such Interest as shall become due on such Mortgage as aforesaid and towards paying the said Annuity yearly as it becomes due and towards paying the said Legacies to my said Grand Children when they become due and so to continue to receive and take the said Rents and Profits thereof untill out of the same they shall have paid all sums then due out of my said Lands by virtue of this my Will land all Costs and Charges attending the recovering receiving and applying the same to the uses and purposes mentioned in this Will but for no other uses whatsoever

Also I give and devise All that my undivided Moiety of a Messuage or Tenement and Home Close to the said Messuage adjoining situate and being in the Town of Claxton otherwise Long Clawson aforesaid to my said son Andrew Guy his Heirs and Assigns fore ever

Also I give and bequeath the sum of Fifty Pounds to be paid by my Executor to my Daughter Elizabeth Wilford Two Years after the Birth of her first Child

All the Residue and Remainder of my Goods Chattels Cattle and Personal [“estate” missing] of what nature or kind soever and wheresoever I give and bequeath to my said son Andrew Guy whom I do hereby make and ordain whole and sole Executor of this my last Will and Testament

In Witness whereof I the said Mary Guy have to this my last Will and Testament set my Hand and Seal this Thirtieth Day of December One Thousand seven Hundred & eighty two

The within written Will and Testament was Signed Sealed published and declared by the within named Mary Guy as and for her last Will and Testament in the presence of us who at her request in her presence and in the presence of each other subscribed our names as Witnesses thereunto
