John Green of Long Clawson 1881 Will

This is the last Will of me John Green of Long Clawson in the County of Leicester Labourer

I bequeath all my Household Furniture Linen and Household Effects and all other my Personal Estate to my Wife Elizabeth Green absolutely

I devise all the Real Estate of which I shall died possessed situate at Long Clawson aforesaid or elsewhere to my said Wife and her assigns during her life without impeachment of waste and after her death I devise my said Real Estate to my Son Joseph Green and to Alfred Pywell of Melton Mowbray Solicitors Clerk their heirs and assigns Upon Trust to sell the same and after paying the expenses of the sale and any principal money that I may own on Mortgage at my death to divide the residue between my four Sons or such of them as shall be living at the death of my said Wife Provided always and I hereby declare that if any of my Sons shall die in my lifetime or in the lifetime of my said Wife leaving a Child or Children then living then and in such case such last mentioned Child or Children shall take (and if more than one equally between them) the share which his her or their parent would have taken if such parent had survived me and my said Wife

Having lent to my Son John who is now residing in America the sum of Ten Pounds in the Month of May 1869 and to my Son George a like sum in the Month of March 1877 I hereby declare that the same sums with interest thereon from the dates of advancing after the rate of Five pounds per centum per annum shall be deducted from the shares of my said Sons John and George and I further declare that if my Son John shall not claim the share to which he will be entitled under this my Will within the period of 7 years after the same shall become payable, the same shall, at the expiration of the said seven years, be paid to his surviving Brothers in equal shares.  I wish the amount to be placed in some Savings Bank until it is claimed by my said Son John

I charge my Real Estate with the payment of any sum I may owe to my Son Joseph at my death or that may be owing to him at the death of my Wife, and I appoint my said Son Joseph Green and the said Alfred Pywell Executors of this my Will

Signed by the above named Testator as his last Will in the presence of us who in his presence at his request and in the presence of each other have hereunto subscribed our names as attesting Witnesses the words “the payment of” having been first interlined

Proved at Leicester on the Eighteenth day of November 1881 by the Oaths of Joseph Green the Son and Alfred Pywell the Executors to whom Administration was granted

The Testator John Green was late of Long Clawson in the County of Leicester Labourer and died on the Twenty eighth day of January 1881 at Long Clawson aforesaid
