Thomas Goodburn of Nether Broughton 1814 Will

In the name of God Amen I Thomas Goodburn of Nether Broughton in the County of Leicester Labourer being weak in body but of a sound and well disposing mind memory and understanding praised be Almighty God for the same do make publish and declare this to be my last Will and Testament in manner following (that is to say)

First I Give and Devise to my Wife Alice Goodburn all that my Messuage Cottage or Tenement Yard Gardens Orchards and all other out buildings thereunto adjoining and belonging with their and every of their rights members and all other out buildings thereunto adjoining and belonging with their and every of their rights members and appurtenances belonging thereto situate standing lying and being at Nether Broughton aforesaid to hold unto her my said Wife Alice Goodburn during the Term of her natural Life

And from and after her decease I Give and devise the aforesaid Messuage Cottage or Tenement Yard Gardens Orchards and all other out buildings thereunto adjoining and belonging with their and every of their rights members and appurtenances belonging thereto situate standing lying and being at Nether Broughton aforesaid to hold unto my Son Thomas Goodburn during the term of his natural Life

And from and after his decease then I Give and Devise the aforesaid Messuage Cottage and premises with all their rights members and appurtenances unto the Male heirs of him my said Son Thomas Goodburn so long as there remain any and for want of such Issue then I Give and Devise all the foresaid Premises to the right heirs and assigns of him my said Son Thomas Goodburn forever But my mind and Will further is that my said Son Thomas Goodburn shall pay or cause to be paid unto my Sons and Daughters hereinafter named out of the said Cottage and premises hereinbefore devised as follows namely

To my Sons John and Joseph Goodburn and to my Daughters Ann Bamford the Wife of George Bamford Sarah James the Wife of John James Mary and Elizabeth Goodburn the sum of ten pounds each of good and lawfull money of Great Britain to be paid unto each of them at the end of twelve months next after my Decease and my said Wifes Decease by my said Son Thomas Goodburn or his Assigns but if my said Daughters Ann Bamford and Sarah James should happen to Die before their said Legacies or Legacy of one or both of them so Dying before they become due as aforesaid then my mind and Will is that the said Legacy or Legacies of one or both of them so Dying shall go and be paid to each of their respective children share and share alike and I do hereby make the said Messuage Cottage and Premises to stand charged and chargeable to and with the payment of the aforesaid Legacies or sums of Money as well the said personal Estate belonging unto me that he may be possessed of at the time of my and my said Wife Decease

Also I Give and bequeath to my said Wife Alice Goodburn all my household goods and Implements of household Beasts Sheep quick and dead Stock and all personal Estate of what nature or kind soever and wheresoever the same is or are in Nether Broughton aforesaid or elsewhere belonging unto me to hold unto my said Wife Alice Goodburn during the term of her natural Life and from and after her Decease I Give and bequeath such said personal [“estate” missing] as may then remain to my Son Thomas Goodburn or his Assigns

And Lastly I do hereby nominate constitute and appoint my said Wife Alice Goodburn whole and sole Executrix of this my last Will and Testament revoking all former Wills by me at any time heretofore mentioned she my said Wife paying all my just Debts and funeral expenses

In Witness whereof I the said Thomas Goodburn Testator of this my last Will and Testament have set my hand and Seal this twenty sixth day of May in the Year of our Lord one thousand eight hundred and thirteen

NB. the words Labourer, Goodburn, Premises, and before they, was duly made before the Testator signed the same

Signed Sealed published and declared by the said Testator Thomas Goodburn as and for his last Will and Testament in the presence of us who have subscribed our names as Witnesses hereto in his presence at the request of the said Testator and in the presence of each other

Let probate be granted to Alice Goodburn of Broughton (Nether) sole Executor of the within written Will, she being sworn to the due Execution thereof & made oath that the whole personal estate of the Testator Thomas Goodburn, Cottager, who died June 9th 1814 did not amount at the time of his death to the sum of One hundred pounds
