John Dixon of Eastwell 1848 Will

This is the last Will and Testament of me John Dixon of Eastwell in the County of Leicester Grazier

First I direct all my just debts funeral and Testamentary expences to be fully paid

I Give devise and bequeath unto my two friends The Reverend Joseph Bick of Eastwell aforesaid Clerk and Andrew Shipman of Eaton Lodge in the Parish of Eaton in the said County of Leicester Grazier their heirs Executors Administrators and Assigns All that my Messuage or Tenement situate in King Street in Melton Mowbray in the said County of Leicester with the Appurtenances And also all my Personal Estate and Effects (of which I direct an Inventory to be taken immediately after my death) whatsoever and wheresoever and of what nature or kind the same may be of which I shall die possessed for the purpose of carrying on the management of my Farm (… requesting my Landlord to continue my Wife Jane Dixon as tenant thereof) and for the maintenance and support of my said Wife Jane Dixon and my Daughter Mary Ann Dixon and to pay the rents and profits thereof unto my said Wife so long as she shall continue my Widow

And in case my said Wife shall marry again then in lieu thereof I Give and bequeath unto her the sum of One hundred pounds absolutely

And as to my said real Estate and all the rest residue and remainder of my personal Estate and Effects (after the death or marriage of my said Wife which shall first happen) I Give devise and bequeath unto my said Daughter Mary Ann Dixon her heirs Executors Administrators and Assigns

But in case my said Daughter Mary Ann Dixon shall marry during the lifetime of my said Wife and whilst she continues my Widow Then I Give and bequeath one half of the rents and profits of my said Messuage or Tenement in Melton Mowbray aforesaid to her Executors Administrators and Assigns And I direct that her receipt alone notwithstanding her Coverture shall be a sufficient discharge to my said Trustees or the survivor of them his Executors Administrators and Assigns

Provided always and I do hereby declare that my said Trustees and the survivor of them his heirs Executors Administrators and Assigns shall be chargeable for such monies only as they respectively shall actually receive by virtue of the trusts hereby in them reposed notwithstanding their or any of their giving or signing or joining in giving or signing any receipt or receipts for the sake of conformity and not one for the other but each for his own Acts only or for involuntary losses And also that it shall and may be lawful for them out of the monies which shall come to their respective hands by virtue of the trusts aforesaid to reimburse themselves respectively all costs and expences which they may sustain expend or be put unto in or about the execution of the aforesaid trusts or in relation thereunto

And I do hereby nominate and appoint my said Wife Jane Dixon Sole Executrix of this my last Will and Testament hereby revoking all former Wills by me made

In Witness whereof I have hereunto set my hand this Eighteenth day of July One thousand Eight hundred and forty four

Whereas I John Dixon of Eastwell in the County of Leicester Grazier have made and duly executed my last Will and Testament in writing bearing date the eighteenth day of July One thousand eight hundred and forty four Now I do hereby declare this present writing to be a Codicil to my said Will and I direct the same to be annexed thereto and taken as part thereof

Whereas I have in and by my said Will Appointed my two friends the Reverend Joseph Bick and Andrew Shipman to be Trustees of my said Will Now I do hereby also appoint my friend Thomas Beaumont Shilcock of Hose Grange in the Parish of Hose in the said County Grazier to be a joint Trustee with the said Joseph Bick and Andrew Shipman and to Act jointly with them in every respect under the Trusts contained in my said Will and do also invest him with the same powers and indemnities as in the said Will is contained with regard to my other two trustees

And I do hereby ratify and confirm my said Will in every other respect

In Witness whereof I the said John Dixon have to this Codicil set my hand this first day of June One thousand eight hundred and forty seven

Jane Dixon of Eastwell in the County of Leicester Widow the sole Executrix in this Will named was duly sworn to the Truth and faithful performance thereof as usual and that the Goods Chattels and Credits of the deceased do not amount in value to the Sum of three hundred pounds (£300) and that the deceased died on the 15th day of July last past
