Martha Derbyshire of Plungar 1927 Will

This is the Last Will and Testament of me Martha Derbyshire of Plungar in the County of Leicester Widow

I Appoint my Son in Law John William Kirk and William Barrett of Plungar Carrier to be the Executors and Trustees of this my Will

I Give to each of my Daughters Louisa Kirk and Mary Ellen Derbyshire the sum of Two hundred pounds

I Give to my said Daughter Mary Ellen Derbyshire in fee simple my small croft situate at Plungar containing about three roods

I Give and Bequeath all my other property both real and personal unto my Trustees Upon Trust to sell and convert the same into money and out of the proceeds of such sale and conversion and out of my ready money to pay my just debts funeral and testamentary expenses and the said legacies and to divide the surplus of my residuary estate unto and equally between my said two Daughters and if only one of them be living at my death the whole to go to such one Provided that if either of my said Daughters shall die in my lifetime leaving issue who shall attain twenty one years of age such issue shall take (equally between them if more than one) the legacy of Two hundred pounds and share of residue which their Mother would have taken if she had been living at my death

I Empower my Trustees or other the Trustees or Trustee for the time being of this my Will at their discretion to raise the expectant share of any infant and pay the same to his or her Father or apply the same themselves for such infant’s education advancement or benefit

In Witness whereof I have hereunto set my hand this ninth day of March One thousand nine hundred and fourteen

This is Codicil to my above written will whereby I give to my Daughter Mary Ellen Derbyshire absolutely all my household furniture and effects and the valuation of the Public House occupied by me and the benefit of the tenancy thereof

In all other respects I confirm my said Will and especially the clause substituting the issue of my deceased daughter Louisa Kirk for their Mother
