This is the last Will and Testament of me Thomas Cobley of Stathern in the County of Leicester Grazier

In the first place I will and direct that my funeral expences and just debts be discharged

I Give and bequeath unto my beloved Wife Mary Cobley and to my Son John Cobley jointly my House and Premises situate at Stathern in the County of Leicester together with the land thereunto belonging called by the names of the Home-close Lees-close and land-close and containing by admeasurement six Acres More or less That is to say I Give unto my Wife Mary Cobley and to my Son John Cobley jointly my aforesaid House and land situate at Stathern aforesaid on condition that they pay to my Daughter Mary Wife of James Rouse an annuity of seven Pounds a year during her natural life the same annuity being no ways subject to the debts or controul of her Husband and the same annuity to arise from the House and land situate at Stathern in the County of Leicester and called by the names of the Home Close Less close and land-close and containing by admeasurement six acres more or less The same annuity to be paid to my Daughter Mary Rouse by half yearly payments

I Also Give and bequeath unto my Wife Mary Cobley and to my son John Cobley jointly my House and Premises at Scalford in the County of Leicester together with a piece of Land situated in the Lordship of Scalford aforesaid called by the name of the Long-close and containing by admeasurement Two Acres more or less That is to say I make my Wife Mary Cobley joint Heiress with my son John Cobley to the House and Land situated at Stathern aforesaid and also to my House and land situate at Stonesby and also to my House and land situate at Scalford aforesaid during her natural life only After the decease of my Wife Mary Cobley I then give and bequeath my House and land situate at Stathern and Also my House and land situate at Stonesby and Also my House and land situate at Scalford aforesaid Unto my Son John Cobley his Heirs Executors Administrators and Assigns for ever on condition of his paying the aforesaid annuity of Seven Pounds to my Daughter Mary Rouse Wife of James Rouse during her natural life

I Give and bequeath to my Grandaughter Mary Ann Sumner the sum of Ten Pounds of good and lawful money of Great Britain to be paid to her by my aforenamed Heirs and Executors when she shall come to the age of Twenty on Years and in case she don’t attain to the age of Twenty one years then I Give the above Ten Pounds to her sister Hannah Sumner when she doth come to the age of Twenty one years

I Also Give and bequeath to my daughter Elizabeth the Wife of Francis Sumner the sum of Forty Pounds to be paid Twelve months after my Decease

And I also Give and bequeath the sum of Forty Pounds to my Daughter Hannah the Wife of William Smith to be paid Twelve months after my decease

I then Give and bequeath all the Residue of my Monies Goods Chattels Effects and real or personal Estate of whatever kind nature of wheresoever unto my beloved Wife Mary Cobley and my Son John Cobley jointly whom I do hereby nominate and appoint to be joint Executors of this my last will and Testament That is to say I appoint my Wife Mary Cobley joint Executrix with my son John Cobley to the Residue of my monies Goods Chattles Effects and real or personal estate of whatever kind nature or wheresoever during her natural life only After the decease of my Wife Mary Cobley I then Give and bequeath all the Residue of my Monies Goods Chattles Effects and real or personal Estate of whatever kind nature or wheresoever unto my son John Cobley his Heirs Executors Administrators and assigns for ever and hereby revoking all former Wills by me made I do declare this to be my last Will and Testament

In witness whereof I have hereunto set my hand and seal this Second day of August in the year of our Lord one thousand eight hundred and twenty one

Signed sealed delivered and declared by the said Thomas Cobley the Testator as and for his last Will and Testament in the presence of us who have hereunto subscribed our names as witness thereunto

Let a probat be granted to John Cobley of Stathern Farmer & Grazier one of the Executors named in the will of Thomas Cobley who died at Stathern on the 6th day of February 1826 with power of making the same like grant to Mary Cobley the Executrix named within when she shall apply for the same

He the said John Cobley being duly sworn as well to the faithful execution of the will as that the Testator’s Goods, Chattles & Credits, as they were at his death, without deducting any debts owing by him therefrom, did not amount in value to the Sum of six hundred pounds
