Joseph Wright Bissill of Nether Broughton 1883 Will

This is the last Will and Testament of me Joseph Wright Bissill of Nether Broughton in the County of Leicester Farmer

I direct all my just debts funeral and testamentary expenses to be paid by my Executors hereinafter named as soon as conveniently may be after my decease

I give to my dear Wife Mary all my Wines Liquors and consumable Household Stores and Provisions in my House at the time of my decease for her absolute use and benefit

I give devise and bequeath unto my friends William Woodroffe of Costock in the County of Nottingham Farmer and John Wright of Nether Broughton aforesaid Farmer their heirs executors administrators and assigns (hereinafter called my said Trustees or Trustee) All and singular my real Estate whatsoever and wheresoever and all my Money and securities for money Household goods and furniture Farming Stock and Crop and all the residue of my personal Estate and Effects of what nature or kind soever Upon Trust to permit and suffer my said Wife to have the use and enjoyment of the whole or such portion as she may require of my Household furniture plate linen and china and other Household effects during such period of her natural life as she shall continue my Widow and unmarried and from and immediately after the decease or marriage of my said Wife whichever shall first happen I direct that the said Household furniture plate linen china and other Household furniture plate linen china and other Household effects shall sink into and form part of my residuary personal Estate and upon Trust to realize get in and convert into money the residue of my personal Estate and to stand possessed of the moneys arising from the sale getting in and conversion thereof and thereout in the first place to pay my aforesaid debts funeral and testamentary expenses and invest the residue thereof in the names or name of my said Trustees or Trustee or the Trustees or Trustee for the time being of this my Will in any of the Public Stocks or Funds or Government Securities of the United Kingdom or upon real Securities in England or Wales or on Loan or Debenture to any Railway Canal Navigable River Gas or Water Company or Companies established in England and paying Dividends on the ordinary Capital of such Company or Companies and upon Trust to pay the rents and profits of my said real Estate and the annual income of my said residuary personal Estate unto my said Wife during such period of her natural life as she shall continue my Widow and unmarried

And from and immediately after the decease or marriage of my said Wife whichever shall first happen as to my real Estate Upon Trust to sell the same either together or in lots and either by Public Auction or Private Contract and for such price or prices and subject to such Conditions of Sale as to my said Trustees or Trustee may appear expedient with liberty to buy in my said real Estate or any part thereof at any such Auction or to rescind or vary any Contract or Contracts for Sale and to resell the Premises without incurring personal responsibility thereby And I direct my said Trustees or Trustee or the Trustees or Trustee for the time being of this my Will to stand possess of the moneys to arise from the Sale of my real Estate and from the sale getting in and conversion of my said residuary personal Estate and the investments for the time being representing the same Upon Trust to pay and divide the same to and amongst all my Children then living and if more than one in equal shares and proportions as tenants in common and if only one then to such one Child wholly Provided always and I do hereby Declare that if any of my Children shall die leaving issue living on the death or marriage of my said Wife who shall live to attain the age of twenty one years then and in such case such issue shall stand in the place of and take the same share under this my Will as his her or their Parent would have taken if living and if more than one equally

And I hereby Declare that the receipts of the Trustees or Trustee for the time being acting in the execution of the trusts hereof for the purchase moneys of real Estate sold and for all other moneys paid to them or him in pursuance hereof or of any of the trusts hereof shall effectually discharge the purchasers or other persons paying the same therefrom and from being concerned to see to the application or answerable for any misapplication thereof and I hereby Declare that if the said Trustees hereby appointed or either of them or any Trustee or Trustees to be appointed as hereinafter provided shall die or be desirous of being discharged from his office of Trustee or shall refuse or become incapable to act then and so often as the same shall happen the said Trustees or Trustee (and for this purpose any retiring Trustee shall be considered a Trustee) may appoint any other fit person or persons to be a Trustee or Trustees in the place of the Trustee or Trustees so dying or desiring to be discharged or refusing or becoming incapable to act And upon every such appointment the said Trust Premises shall be so transferred that the same may become vested in the new Trustee or Trustees jointly with the surviving or continuing Trustee or Trustees or solely as the case may require and every such new Trustee shall (both before and after the said premises shall have become so vested) have the same powers authorities and discretions as if he had been hereby originally appointed a Trustee

And I declare that the Trustees for the time being of this my Will shall be chargeable only with such moneys as they shall respectively actually receive and not for moneys received under receipts in which they shall join for conformity only and that they shall not be answerable the one for the other of them nor for any insufficiency or deficiency of any stock or securities whereon my Estate or any part of it may be invested nor otherwise for involuntary losses

And that they shall and may reimburse themselves and each other out of the moneys which shall come to their hands under the trusts aforesaid all costs charges and expenses whatsoever incurred in the execution of the trusts aforesaid or in anywise in relation thereto

Lastly I appoint the said William Woodroffe and John Wright Executors of this my Will and devise to them their heirs and assigns all Mortgaged and trust Estates now vested in me upon the Trusts and subject to the Equities affecting the same respectively

In Witness whereof I the said Joseph Wright Bissill have to this my last Will and Testament contained in three Sheets of paper set my hand this Thirtieth day of March one thousand eight hundred and seventy two

The Testator Joseph Wright Bissill was late of Nether Broughton in the County of Leicester Farmer and died on the Sixteenth day of August 1882 at Nether Broughton aforesaid
