Elizabeth Barker of Nether Broughton 1851 Will

This is the last Will and Testament of me Elizabeth Barker of Nether Broughton in the County of Leicester Widow that is to say

I give and devise All my Messuages Closes Lands Tenements and Real Estate whatsoever and wheresoever unto my Nephew John Grice of Upper Broughton in the County of Nottingham Carpenter his heirs and assigns for ever Subject nevertheless to and charged and chargeable with the payment of the several Legacies hereinafter mentioned that is to say

I give and bequeath the sum of three hundred pounds unto and equally between my nephews and nieces the Brothers and Sisters of the said John Grice and to the issue of such of them as may happen to be dead at the time of my decease leaving issue share and share alike but the issue of any deceased Nephew or Niece shall not have or be entitled to a greater share amongst them than their parent or parents would have been entitled to if living

I give and bequeath the further sum of three hundred pounds unto and equally between my Nephews and Nieces the Sons and Daughters of my late Sister Sarah Baldock deceased and to the issue of such of them as may happen to be dead at the time of my decease leaving issue share and share alike but the issue of any such last mentioned Nephews or Nieces shall not have or be entitled to a greater share amongst them than their parent or parents would have been entitled to if living

And I charge and make chargeable my said Real Estate with the payment of the said two several sums of three hundred pounds accordingly within twelve calendar months next after my decease and expressly exonerate and discharge my Personal Estate from the payment of the same and every part thereof

Whereas my Brother Thomas Gill is indebted to me in the sum of sixty pounds on his Prommissory Note of Hand Now I hereby give and bequeath to the said Thomas Gill the Interest of the said sum of sixty pounds during the term of his natural life

I direct my Executor hereinafter named immediately after my decease to obtain from the said Thomas Gill a fresh Prommissory Note of Hand in his name for the said sum of sixty pounds and to have the same renewed every six years during the life of my said Brother Thomas Gill and immediately after the decease of my said Brother Thomas Gill I give and bequeath the said sum of sixty pounds unto and equally between and amongst the Sisters of the said Thomas Gill and to the issue of such of them as may happen to be dead at the time of my decease leaving issue share and share alike but the issue of any deceased Sister of the said Thomas Gill shall not have or be entitled to a greater share amongst them than their parent or parents would have  been entitled to if living

I give to Phebe Goodacre Daughter of John Goodacre of Upper Broughton aforesaid Tailor my Silver Cup

I give and bequeath all the rest residue and remainder of my Monies Securities for Money Plate Linen Goods Chattels Effects and Personal Estate whatsoever and wheresoever unto my said Nephew John Grice subject nevertheless to and charged and chargeable with the payment of my just Debts and the several Legacies hereinafter mentioned within twelve calendar months next after my decease that is to say

To my Niece Sarah Goodacre Wife of the said John Goodacre the sum of ten pounds

To Phebe Milnes, Mary Milnes, Emma Milnes and Elizabeth Brewin late Elizabeth Milnes four Daughters of Charles Milnes of Nether Broughton aforesaid the sum of five pounds apiece

To Charles Milnes Son of the before mentioned Charles Milnes the sum of ten pounds

To Hannah Elson and Emma Elson two Daughters of Mr Elson of Goadby Marwood in the said county of Leicester the sum of five pounds apiece

To John Elson Son of the said Mr Elson the sum of ten pounds

To my Nephew John James and my two Nieces Elizabeth James and Sarah Wagg late Sarah James of Burton on the Wolds in the said County of Leicester the sum of five pounds apiece

To my Sister Mrs Hopkins of Costock in the County of Nottingham Widow the sum of five pounds

I appoint the said John Grice sole Executor of this my Will and I hereby revoke and make void all former and other Wills by me at any time heretofore made and I declare this to be my last Will and Testament

In Witness whereof I the said Elizabeth Barker the Testatrix have to this my last Will and Testament set my hand and seal the seventeenth day of July in the year of our Lord one thousand eight hundred and forty eight

Signed sealed published and declared by the said Elizabeth Barker the Testatrix as and for her last Will and Testament in the joint presence of us present at the same time who at her request in her presence and in the presence of each other have hereunto set our names as Witnesses thereto the words “within twelve calendar months next after my decease” between the twentieth and twenty first line from the top of the first page being first interlined

John Grice of Upper Broughton in the County of Nottingham Carpenter the sole Executor in this Will named was duly sworn to the truth and faithful performance thereof as usual and that the Goods Chattels and Credits of the deceased without deducting any Debts owing by her therefrom do not amount in value to the Sum of Two hundred Pounds and that the deceased died on the 29th day of January last
