Joseph Wright of Nether Broughton 1841 Will

This is the last Will and Testament of me Joseph Wright of Nether Broughton in the County of Leicester Grazier

First I desire all my just debts funeral and Testamentary expences to be fully paid

I Give Devise and bequeath All my Lands Tenements hereditaments and real Estate whatsoever with their appurtenances situate at Nether Broughton aforesaid or elsewhere And also All my Personal Estate and Effects of every description of which I shall die possessed unto my two friends Thomas Read and William Urry both of Nether Broughton aforesaid Graziers their heirs executors administrators and assigns for ever Upon this Special Trust and confidence Nevertheless that they my said Trustees or the Survivor of them or the heirs executors or administrators of such survivor do and shall receive the Rents issues and profits of my said Real and personal Estate and Effects and apply the same for the benefit of my affectionate Wife Susannah Wright (if she continues my widow) and for the Maintenance education and bringing up of my son John Wright until he attains his Age of Twenty one years And when he attains the same Then I Give Devise and bequeath All my said Real and Personal Estate and Effects unto my said Son John Wright his heirs executors administrators and assigns for ever (Subject nevertheless to the payment of the following Annuity to his Mother)

I Give and devise unto my said Wife Susannah Wright and her assigns for and during such part of her natural life only as she shall continue my widow One Annuity or yearly Sum of Fifteen pounds of lawful English money which I will shall be paid half yearly namely on the Sixth day of April and the Eleventh day of October in every year The first payment of which I direct shall be made on either of the said days as shall first happen after my said Son shall attain to his age of Twenty one years

But in case my said Son shall happen to die under Age as aforesaid Then I Give Devise and bequeath all my said Real and Personal Estate and Effects with their appurtenances unto my Three Sisters Mary Hill, Elizabeth Raynor and Sarah Bissill their heirs executors administrators and assigns for ever as Tenants in common and not as joint Tenants provided I shall have no more issue by my present Wife born during my life or in due time afterwards But if There should be any after born child or children Then and in such case I revoke the last Devise and bequest And do give devise and bequeath All my said Real and personal Estate and Effects unto such after born child or children his her or their heirs executors administrators or assigns for ever as Tenants in common if more than one And if but one Then to such only Child his or her heirs executors administrators and assigns for ever

And my Will further is that in case my said Son John Wright shall happen to die under age as aforesaid Then in lieu of the said Annuity of Fifteen pounds before given to my said wife I Give to her an Annuity of Twenty pounds payable on either of the said half yearly days of payment as shall first happen after the decease of my said Son under Age as aforesaid provided she shall continue my Widow but not otherwise And I charge all my Real and Personal Estate with the true payment thereof Provided and my Will expressly is that in case my said Wife shall have hereafter any other Child or Children by me begotten or born in due time after my decease Then and in such case I do hereby Give to such after born Child or Children the Sum of One hundred pounds apiece to be paid to him her or them as the as the case may be when and as he she or they shall attain his her or their Age or Ages of Twenty one years And I do hereby Subject and charge all my said Real and Personal Estate with the true payment thereof

And I declare my mind and will to be that my said Trustees be at liberty out of the said Trust premises to Retain all necessary costs charges and expences they may be at or put to in executing the Trusts of this my Will and that neither of them shall be answerable for any thing except his or their Wilful neglect or default not one for the other but each for his own wilful acts deeds neglects and defaults only

And Lastly I do hereby appoint the said Thomas Read and William Urry Trustees and Guardians for my said Child John Wright and for any after born child or children and also Joint Executors In Trust of this my last Will and Testament hereby Revoking all former Wills by me made

In Witness whereof I have hereunto set my hand and Seal this Eighth day of May one thousand eight hundred and Thirty two

Signed sealed published and declared by the said Testator Joseph Wright as and for his last Will and Testament in the presence of us who have at his Request in his presence and in the presence of each other set our hands as Witnesses to the due execution thereof the several erasures and interlineations being first made

William Urry of Nether Broughton in the county of Leicester Grazier surviving Executor in this Will named was duly sworn to the truth & faithful performance thereof as usual and that the goods chattels and credits of the deceased without deducting any debts owing by him therefrom do not amount in value to the sum of six hundred pounds and that the deceased died on the Eleventh day of November last
