Jonathan Whitaker of Nether Broughton 1866 Will

I Jonathan Whitaker of Nether Broughton in the County of Leicester Grazier do here make and publish this my last Will and Testament

I Give unto my dear Wife Elizabeth Whitaker and my daughter Anne Whitaker All and singular my Furniture plate Linen household goods and chattels used in and about my dwellinghouse where I now live together with all my live and dead stock implements of Husbandry and the like upon my said premises also all my personal property whatsoever as their sole right And in trust to pay to my eldest daughter Mary Marson the sum of Nineteen Guineas one year after my decease

Also I bequeath to my Granddaughter Mary Ann Marson the sum of Nineteen Guineas but should my eldest daughter die before my said Wife Elizabeth Whitaker I hereby direct and will that the said Nineteen Guineas be put in the Savings Bank for the use of the children of the said Mary Marson to be equally divided among them and each to have its share as they come of age

I also will and direct that should my Granddaughter Mary Ann Marson die before her Aunt the said Ann Whitaker that the said bequest shall be null and void

I also will and direct that should my Wife die soon after me my daughter Anne Whitaker shall not be obliged to pay the said bequest to my eldest daughter in less than two years

I also will that my said daughter Anne shall not be obliged to pay the said Legacy above named to my Granddaughter in less than two years after my decease in case my Wife should die soon after me

I also will and direct that my Son in Law Henry George Marson shall continue the occupation of the land he now holds so long as he does not interfere by taking away his daughter from her aunt or Grandmother but should he do so it is my Wish that they should resume the occupation of the land themselves

Lastly I do hereby nominate and appoint my Two Friends Mr John Weldin Grazier Broughton and John Skinner Junr Baker joint Executors of this my last Will and Testament

And I will and direct that they shall reimburse to themselves all reasonable and necessary expenses in fulfilling the same

The Testator Jonathan Whitaker was late of Nether Broughton in the County of Leicester Grazier and died on the twelfth day of December 1865 at Nether Broughton aforesaid
