This is the last Will and Testament of me Thomas Webster of Scalford in the County of Leicester Gentleman

I direct payment of all my just debts funeral and testamentary expenses by my Executors hereinafter named as soon as conveniently may be after my decease out of my Personal Estate

I appoint James Thomas Webster Wilson of Carrington in the extended Borough of Nottingham Solicitors Clerk and William Thomas Kirk of Scalford aforesaid Farmer Trustees and Executors of this my Will

I give and bequeath all my household furniture plate linen china jewels and all my household effects of every kind and description unto my dear Wife Ann absolutely

I devise all those my four Messuages dwellinghouses or Tenements with the appurtenances situate in Amis Street Melton Mowbray in the said County of Leicester unto and to the use of my said Wife and her assigns for her life without impeachment of waste And after her decease I devise the said four Messuages and premises in manner following that is to say

To the use of John Page of Melton Mowbray aforesaid Butcher for his life and after his decease To the use of Elizabeth Page Wife of the said John Page for her life and on the death of the survivor of them the said John Page and Elizabeth his Wife to the use of Mary Ann the Wife of William Miller of Cattistock in the County of Dorset Butler for her life and on her decease To the use of her two children William Miller and Clara Miller their heirs and assigns for ever as tenants in common

As to all the rest residue and remainder of the real and personal estate whatsoever and wheresoever to which I shall be entitled at the time of my decease I give devise and bequeath the same unto and to the use of the said James Thomas Webster Wilson and William Thomas Kirk their heirs executors administrators and assigns respectively Upon Trust that they or the survivor of them or the heirs executors or administrators of such survivor their or his assigns do and shall allow my said Wife to occupy the house and premises in which I now reside for her life rent free And upon further trust that my said Trustees or Trustee shall receive the whole of the rents interest and dividends arising from my said residuary real and personal estate and thereout in the first place keep my said real estate in a proper and tenantable state of repair and then upon trust to pay thereout unto my said Wife an Annuity or clear yearly sum of two hundred pounds by four equal quarterly payments the first payment to become payable and be paid at the expiration of three calendar months from my decease

And I direct my said Trustees or Trustee from time to time to invest any surplus income either with any Banker or in any other mode they or he may think most advantageous for my Estate providing always that such period of investment shall not exceed Twenty one years

And on the death of my said Wife I direct my said Trustees or Trustee to stand possessed of the whole of my said residuary real and personal Estate and accumulations of income Upon and for such trusts uses ends intents and purposes as my said Wife shall by her last Will and Testament or any Codicil or Codicils thereto direct limit or appoint give or devise the same

And I devise all Estates vested in me as a Trustee or Mortgagee unto and to the use of the said James Thomas Webster Wilson and William Thomas Kirk their heirs and assigns upon the trusts and subject to the Equities affecting the same

I hereby revoke all former and other Wills by me at any time heretofore made

In Witness whereof I have to this my last Will and Testament contained in this and the preceding sheet of paper signed my name this Thirtieth day of August One thousand eight hundred and seventy nine

This is a Codicil to the last Will and Testament of me Thomas Webster of Scalford in the County of Leicester Gentleman which Will bears date the Thirtieth day of August One thousand eight hundred and seventy nine

Whereas I have in and by my said Will after making certain specific devises and bequests devised and bequeathed all my residuary real and personal estates unto and to the use of James Thomas Webster Wilson and William Thomas Kirk my Trustees as therein mentioned Upon Trust out of the income arising from my said residuary real and personal estates in the first place to keep such real estate in tenantable repair and then to pay unto my Wife Ann an Annuity of two hundred pounds a Year for her life by equal quarterly payments and then I have directed the surplus income arising from my said residuary real and personal estate to be invested for a period not exceeding Twenty one years as in my said Will is mentioned Now I do hereby revoke the gift of the said annuity of two hundred pounds to my said Wife and also the direction for accumulation of surplus income respectively contained in my said Will and in the place and stand thereof I direct my said Trustees or Trustee in the first place to keep my said residuary real estate in tenantable repair and condition and then to pay the whole surplus income arising from my said residuary real and personal Estate to my said Wife for her life for her sole and absolute benefit

In all other respects I confirm my said Will

Proved at Leicester with a Codicil on the Thirteenth day of October 1880 by the Oaths of James Thomas Webster Wilson and William Thomas Kirk the Executors named in the Will to whom administration was granted

The Testator Thomas Webster was late of Scalford in the County of Leicester Gentleman and died on the Fourth day of November 1879 at Scalford aforesaid
