Robert Wartnaby of Wartnaby 1738 Will and Inventory

Leicestershire, Leicester and Rutland Archives, Leicestershire Wills and Probate Records 1738

In the name of God Amen [small hole] and Twentyeth day of December 1737 according to the Computation of the Church of England I Robert Wartnaby of Wartnaby in the County of Leicester yeoman being of perfect memory and rememberance praised be God, do make and ordain this my last Will and Testament in manner and form following viz

First I bequeath my Soul into the Hands of Almighty God my Maker hoping through the Meritorious Death and Passion of Jesus Christ my only Saviour and Redeemer to receive free pardon and forgiveness of all my Sins; and as for my body to be buried in Christian Burial at the discretion of my Executor hereafter nominated

Imprimis I give and bequeath to Matthew my beloved Son the Sum of Fifty Pounds of good and lawfull Money of England to be Paid by my Executor

Item I give to my Daughter Ann the Sum of Fifty pounds

Item I give to my Son Richard the Sum of Fifty pounds

Item I give to my Daughter Hannah the Sum of Fifty pounds

All these aforesaid Sums to be paid when they come to the age of Twenty two years by my Executor

Item I give to my Daughters Ann and Hannah all my Houshould goods at the aforesaid age & also the fifty pound provided it comes to be Divided amongst my four youngest Children

Item All the rest of my Houses, Lands, Tenements and Goods whatsoever I give to my beloved Son Robert Wartnaby upon condition that he shall pay all my Debts and Legacies and do make him my Sole Executor of this my last Will and Testament revoking all other Wills and Testaments that has been by me made

Note that if any of the aforesaid children should die the aforesaid sums of money must go to the rest

Bond, bound Mary Wartnaby widow of Wartnaby, John Stevens yeoman of Long Clawson and Stephen Staveley mason £260 24 January 1737/8.

Whereas the above bounden Mary Wartnaby Widow has been duely Elected and Chosen Guardian and Curator of Suites to Robert Wartnaby a Minor the Naturall and Lawfull Son and Sole Extor named in the last will and Testament of Robert Wartnaby late of Wartnaby In the Peculiar Jurisdiction of Rothley Deced Now the Condition of this obligation is That If the above bounden Mary Wartnaby do well and truely Educate maintain and bring up the sd Robert Wartnaby with all things necessary and Convenient for him according to his Degree during his Minority And also Do well and truely Administer all the personall Estate of the sd Robert Wartnaby Deced according to his said will to the Sole Use benefit and Advantage of the sd Extor during his Minority by paying the said Deceds Debts and the Legacyes named in the said will so far as by Law She is obliged, and Doe also produce an inventory then obligation is void.
