John Wadkin of Tugby then Billesdon 1857 Will

This is the last Will and Testament of me John Wadkin of Tugby cum Norton in the County of Leicester Publican and Farmer

First I direct that all my just debts funeral and testamentary charges be fully paid and satisfied as soon as conveniently may be after my decease

I give and bequeath All the stock upon my farm and lands now held by me together with the growing crops and the produce thereof and all implements of husbandry and also all my stock in trade and utensils used in carrying on my said business of Publican unto my daughter Elizabeth Wadkin and my friend William Sherwin of Barclay Street Somers Town in the County of Middlesex Gentleman their Executors and Administrators and the survivors and survivor of them and the Executors and Administrators of such survivor In trust that they the said Elizabeth Wadkin and William Sherwin or the survivor of them her or his executors and administrators shall allow my dear Wife Ann Wadkin to carry on the said trades or either of them but in case she should not elect to carry on the said trades or either of them then I direct that the said Elizabeth Wadkin and William Sherwin shall cause the same to be sold for the best price that can be gotten for the same and the monies to arise from such sale I direct the said Elizabeth Wadkin and William Sherwin to lay out and invest the same in Government or real securities and to pay and apply the interest dividends or annual produce thereof unto my said Wife when and as often as the same shall become due and payable for and during the term of her natural life and from and immediately after her decease I give and bequeath the same and every part thereof unto my daughter Elizabeth Wadkin absolutely

I also give and bequeath All my household goods furniture plate linen china books prints pictures and all other effects of whatever description the same may consist of Unto the said Elizabeth Wadkin and William Sherwin In trust to allow my said Wife the use and enjoyment of the same for and during the term of her natural life and from and immediately after her decease I give and bequeath the same and every part thereof unto my said daughter Elizabeth Wadkin absolutely

And as to all the rest and residue of my personal estate and effects whatsoever I give and bequeath the same unto my said daughter Elizabeth Wadkin absolutely

And I hereby appoint my said daughter Elizabeth Wadkin and my friend William Sherwin Executrix and Executor of this my Will hereby revoking all former Wills by me heretofore made and do declare this to be my last Will and Testament

In witness whereof I have hereunto set my hand this Twelfth 12th day of August in the year of our Lord One thousand eight hundred and fifty two

Twenty fourth day of October 1857

Let a Probate be made to Elizabeth Wadkin of Billesdon in the County of Leicester Spinster the Executrix named in the Will of the deceased William Sherwin the Executor having died in the lifetime of the Testator

She having been first duly sworn to the truth and faithful performance of the Will as usual and to the truth of the usual Affidavit for the Inland Revenue Office that the Goods Chattels and Credits of the Testator without deducting any thing on account of debts due or owing therefrom do not amount in value to the sum of One hundred Pounds and that the said Testator died on the Fifteenth day of October instant
