John Thurman of Long Clawson 1849 Will

This is the last Will and Testament of me John Thurman late of Whittington in the Parish of Grendon in the County of Warwick but now of Long Clawson in the County of Leicester Gentleman

I give and devise all my messuages closes lands and hereditaments situate at Marley in the Parish of Kingsbury in the County of Warwick unto William Cooper Bailiff to the late William P Jago Esquire of Thorpe in the County of Stafford and his assigns for his life and after his death I give and devise the same to William Coleman the second son of William Coleman of Long Clawson aforesaid and to his heirs and assigns for ever

I give and devise all my messuages or tenements closes lands and real estate situate and being at Ratcliffe … in the said County of Leicester and in Grendon in the County of Warwick unto my godson John Thurman Coleman of Long Clawson aforesaid and to his heirs and assigns for ever and it is my wish that he take the name of “Thurman”

And I direct that during the minority of my said Godson the rents and profits of the said estate do accumulate for his benefit and that on his attaining twenty one years of age such accumulations be paid to him by my Executor who is to have the management and letting of the said estates so devised to him as aforesaid and if he should die under twenty one years of age such accumulations to be paid to his Father or to his executors or administrators

I direct my Executor hereinafter appointed to pay all my just debts funeral and testamentary expences out of the first monies which shall come to his hands on account of my personal estate

I give and bequeath the following legacies or sums of money (that is to say)

To Elizabeth Clarke the sum of Two hundred pounds

To each of the sons and daughters of Richard Thurman late of Atherstone deceased One hundred pounds

Also the sum of One hundred pounds, to be divided between the children or paid to the only child of Joseph Thurman deceased (the son of Richard Thurman) and to be paid to him her or them on their coming of age my residuary legatees paying him her or them interest at the rate of four pounds per centum per annum in the mean time

To each of the sons and daughters of Thomas Moorwood of Cliff in the Parish of Kingsbury One hundred pounds

To Walter Coleman Edward Coleman and John Coleman sons of Edward Coleman of Dowon Gentleman One hundred pounds a piece and to Sarah Coleman one of the said Edward Coleman’s daughters Two hundred pounds

To Edward Mayo William Mayo Emma Mayo and Mary Mayo Grandchildren of the said Edward Coleman Twenty five pounds each to be paid to them on their attaining Twenty one years of age the interest in the meantime to be applied for their maintenance and in case any one of them should die under twenty ones years of age his or her legacy to be paid to the survivors or survivor

I give to Elizabeth Thurman of Nuneaton (sister of Edward Thurman of Nuneaton Butcher deceased) the sum of One hundred pounds

To John Thurman (eldest son of the said Edward Thurman Butcher deceased) Two hundred pounds and to the four younger children of the said Edward Thurman deceased Fifty pounds a piece

To Richard Bassett of Polesworth Two hundred pounds

I give unto my housekeeper Alice Welsh an annuity of Thirty pounds per annum during her life if she shall be in my service at the time of my death I direct such annuity to be paid half yearly and the first payment to be made at the expiration of six months from my death

And I give and devise all and singular my messuages farms lands tenements tithes and hereditaments situate and being at Long Clawson aforesaid unto and to the only use of William Coleman son of the said Edward Coleman and now residing at Long Clawson aforesaid his heirs and assigns for ever

And I also give and bequeath all and singular my personal estate and effects whatsoever and wheresoever unto the said William Coleman his executors administrators and assigns subject nevertheless to the payment of my just debts funeral and testamentary expences and the several legacies and annuity hereinbefore bequeathed

And I charge my said real estate at Long Clawson with the payment of so much of my legacies and the said annuity as my personal estate shall fall short of discharging

And I nominate and appoint the said William Coleman sole Executor this my last Will and Testament hereby revoking all former Wills and Codicils by me made

In witness whereof I the said John Thurman the testator have to this my last Will and Testament set my hand this thirteenth day of July one thousand eight hundred and forty five

This is a Codicil to the Will of me the above named John Thurman

I revoke the devise contained in my Will of my estate at Hurley in the Parish of Kingsbury aforesaid and instead thereof I hereby give and devise all my messuages closes and real estate situate at Hurley aforesaid in the said Parish of Kingsbury unto and to the use of William Coleman the second son of the said William Coleman of Long Clawson aforesaid and to his heirs and assigns for ever Subject nevertheless to the payment of an annuity of Forty pounds per annum which I hereby give to the said William Cooper Bailiff to the late Jago Esqr during his life the said annuity to be paid half yearly and the first payment to be made at the expiration of six months from my death

As to the rents and profits of the said estates during the minority of the said William Coleman the Devisee I direct the same to accumulate & be applied in the same manner as I have directed by will as to the rents of my estate at Ratcliffe … (that is) for the benefit of the said William Coleman the devisee and if he shall be under age for the benefit of his Father

And I confirm my said Will in every other respect
