Thomas Thorold of Eaton 1784 Will

This is the Last Will and Testament of me Thomas Thorold of Eaton in the County of Leicester Miller as follows

First I desire to be buried in a decent manner at the discretion of my Executor hereinafter named

And as for my Worldly Estate which hath pleased God to bless me with I give and dispose thereof as follows

Whereas by virtue and in pursuance of the power and authority to be reserved and given in and by a certain Deed Poll bearing date on or about the Fifteenth day of December which was in the year of our Lord One thousand Seven hundred and Seventy Nine and in pursuance and by virtue thereof And Also of all and every Power and Powers Authority and Authorities whatsoever to me in any wise reserved in and by the said recited Deed Poll and now belonging and subject thereunto I Give and Devise All that Messuage or Tenement Yard Garden Hereditaments and Premises with the Appurtenances And Also all those two new inclosed pieces and Parcels of Land and Hereditaments which are situate standing lying and being within the Town, fields, libertys, precincts and Territories of Eaton aforesaid Unto my only Son Samuel Thorold his Heirs and Assigns forever

Also I give and bequeath Unto my two Friends John Exton of Eastwell in the said County of Leicester Gentleman and my Brother in Law William Morris of Branston in the said County of Leicester Grazier the Sum of One hundred pounds to be paid them within twelve months next after the death of my Dear and loving Wife Elizabeth Thorold by my said Executor Upon this Special Trust that they my said two Friends and Trustees John Exton and William Morris and the Survivor of them and the Executors and Administrators of such Survivor do and shall as soon as may be after the receipt of the said Sum of One hundred pounds put and place out the same at Interest upon good and sufficient Security or Securities and with the interest arising therefrom pay and apply the same yearly and every year for and towards the maintenance and Education of my Grand Daughter Elizabeth Thorold only daughter of my late Son Richard Thorold untill she attains her age of Twenty one years And when and as soon as she attains her said Age of Twenty one years Then I direct my said Trustees John Exton and William Morris and the Survivor of them to pay the said Sum of One hundred pounds and all interest that shall be then due for the same unto my said Granddaughter Elizabeth Thorold her Executors or Administrators

But my Mind and Will is that in Case my said Granddaughter Elizabeth Thorold shall dye before she attains her said Age of twenty one years Then I do direct my said Trustees or the Survivor of them to pay the said Sum of One hundred pounds and interest unto my Executor hereinafter named Provided always and my Mind and Will further is that it shall be lawfull to and for my said Trustees hereby appointed as aforesaid to deduct out of the said Sum of One hundred pounds all the reasonable Costs and charges that they or the Survivor of them shall sustain or be put unto in the Execution and management of the said Trust and neither of them shall be answerable for the acts receipts neglects or defaults of the other of them but each for his own acts only and neither of them shall be charged or chargeable with any interest of the said Sum of One hundred pounds other than what shall come to their hands severally and respectively nor for the loss thereof unless it be by or through their wilfull neglect or default

Also I give and bequeath unto my Daughter Elizabeth Johnson the sum of Fifty pounds to be paid her within Twelve months next after the decease of my said Wife Elizabeth Thorold by my said Executor

Also I give and bequeath unto my said Wife Elizabeth Thorold the free use Occupation and benefit of all that my Windmill situate at Eaton aforesaid And Also all my Household Goods Stock Cattle Chattels and Personal Estate for and during the Term of her natural life

Also I give and bequeath unto my said Wife Elizabeth Thorold all my Linen of what sort soever to be freely disposed of by her

Provided always and my express mind and Will is that in Case my said Wife shall intermarry again Then and in such Case I do hereby declared that the bequest of the use and Occupation of my said Windmill Household goods and Personal Estate shall from the Consummation of such marriage cease and be void and the same shall go to my residuary Legatee and Executor

And Lastly I do give and bequeath my said Household goods Wind mill Stock Cattle Chattles and Personal Estate expectant upon and immediately after the death or intermarriage of my said Wife Elizabeth Thorold (and not herein before by me Specifically given) my debts Legacies and Funeral charges being first paid Unto my said only Son Samuel Thorold whom I do constitute and appoint Sole Executor of this my last Will and Testament hereby revoking all other Wills by me at any time heretofore made

In Witness whereof I the said Thomas Thorold the Testator have hereunto set my hand and Seal the Thirtieth day of December And in the Year of our Lord One thousand Seven hundred and Eighty three

Signed Sealed published and declared by the said Thomas Thorold the Testator as and for his last Will and Testament written on two sheets of paper to the first sheet he hath set his hand and to the last affixed his Seal in the presence of us the Witnesses under Written who have at his request and in his presence and in the presence of each other set our hands as Witnesses to the Execution of this his said Will
