William Swain of Eaton 1818 will

This is the last Will and Testament of me William Swain of Eaton in the County of Leicester Farmer As follows

First I direct my just debts Funeral and Testamentary expences to be fully paid

I give and devise All my Messuages Closes Lands Tenements Hereditaments And real Estate situate standing lying and being in Gunby in the County of Lincoln And Sewstern in the County of Leicester with their Appurtenances unto my two friends Christopher Compton of Garthorpe and George Bell of Coston both in the said County their Executors Administrators and Assigns to hold the same unto the said Christopher Compton and George Bell their Executors Administrators and Assigns from the day of my death for during And unto the full end and term of one thousand years from thence next ensuing and fully to be complete And ended upon such trusts And for such Purposes as are hereinafter declared concerning the same that is to say

That they the said Christopher Compton and George Bell or the Survivor of them And the Executors or Administrators of such Survivor shall and do by Mortgage of the said Messuages Cottages Closes Lands Tenements Heredits And part of the same … raise and levy the Sum of five hundred pounds which I will shall be paid unto my Grand Daughter Mary Ann Healey the daughter of my late daughter Ann Healey within twelve months after my decease

And from and immediately after the end or other sooner determination of the said term then I give And devise my said Messuages Closes Lands Tenements Hereditaments And real Estate unto my Grandson William Swain his heirs and Assigns for ever when he shall have attained his full age of twenty one years

And I do hereby Authorize and empower my said Trustees and the Survivor of them his Executors or Administrators from and after my decease until my said Grandson William Swain shall attain to his age of twenty one years to manage And improve the said Estate for his use And benefit

But in case my said Grandson shall happen to die before he attains his said Age of twenty one years then I give and devise my said real Estate And Premises with the Appurtenances unto my Son John Swain his heirs And Assigns forever

I give and bequeath unto my Granddaughter Jane Swain the daughter of my said late Son William Swain the Sum of two hundred pounds to be paid to her when she shall attain to her age of twenty one years

And I do hereby Subject and charge all my said real Estate and Premises with the just and true payment thereof

I give and bequeath unto my daughter Elizabeth Swain the Sum of six hundred pounds unto my daughter Susannah the Wife of the said George Bell the Sum of four hundred Pounds And unto my two Grandsons George Healey and William Healey the Sons of my late daughter Ann Healey the Sum of one hundred pounds apiece which said several Legacies I will shall be paid to them and each of them within twelve months after my decease by my Executor And I do hereby subject and charge all my Personal Estate and Effects with the true payment thereof

And I will and direct that my said Trustees shall be at liberty from and out of all or any part of the said trust monies to retain their respective costs and expences in executing the trust hereby reposed in them And that neither of them shall be answerable or liable for any thing except their own wilful neglect or default

And as to all the rest residue and remainder of my Personal Estate and Effects whatsoever and wheresoever and of what nature or kind soever the same may be I give and bequeath the same and every part thereof subject to the payment of my just debts Legacies Funeral and Testamentary expences unto my said Son John Swain his Executors Administrators And Assigns

And I do hereby appoint my said Son John Swain sole Executor of this my last Will and Testament hereby revoking all former Wills by me made

In Witness whereof I the said William Swain the Testator have hereunto set my hand and Seal this twenty ninth day of July in the year of our Lord one thousand eight hundred and seventeen

Proved at London 7th July 1818 before the Judge by the Oath of John Swain the Son And sole Executor to whom Administration was granted having been first sworn by Commission duly to Administer

On the 12th Nov 1845 Admon (with the Will annexed) of the Goods Chattels and Credits of William Swain late of Garthorpe in the County of Leicester Farmer deced left unadmd by John Swain deced whilst living the Son of the said Deced & the sole Exor & Residuary Legatee named in the said will was granted to Ann Swain Widow the Relict & Administratrix of the Goods of the said John Swain deced she having been first sworn by Comon duly to admr the sd Exor having died intestate
