The Last Will and Testament of John Starbuck the Elder of Hickling Notts made on the 22nd day of February 1826

This is the last Will and Testament of me John Starbuck of Hickling in the County of Nottingham taylor made this twenty second of February in the year of our Lord one thousand eight hundred and twenty six as follows that is to say.

I give and devise All those my undivided five sixth parts in the messuage or tenement yard garden orchard and appurtenances to the same belonging situate at Hickling aforesaid and now in my own occupation And also all that small piece or parcel of land containing two roods and five perches or thereabouts being parcel of a small close containing three roods lying and adjoining to the said orchard and which I purchased of Thomas Wright And also all that my undivided moiety or equal half part of and in the remainder of the said close and also of and in all those two several closes or grounds enclosed containing together three acres one rood and sixteen perches or thereabouts lying

and adjoining to the said small close on the west side thereof And also all other my real estate whatsoever situate lying and being within the parish of Hickling aforesaid with all and singular the appurtenances to the same belonging to William Clay of Hickling shoemaker his heirs and assigns upon trust for the use of my wife Frances Starbuck and my son Martin Starbuck during the time of the natural life of my said wife Frances Starbuck

I likewise give and devise all my household goods and furniture and personal estate whatsoever to the said William Clay his heirs and assigns upon trust for the use and benefit of my wife Frances Starbuck and of my son Martin Starbuck during the time of the natural life of my said wife Frances Starbuck

And after her decease then upon trust that the said William Clay shall and do as soon  as conveniently may be after the decease of my said wife sell and dispose of all the said hereditaments and premises situate at Hickling aforesaid either together or in parcels and likewise all my household goods and furniture and personal estate whatsoever for the most money that can be reasonably be had for the same And I do hereby declare my mind and will to be and do direct accordingly that the receipt and receipts of the said Trustee his heirs and assigns shall be a good and sufficient discharge to the purchaser of the said premises or personal property or any part thereof for so much of the purchase money as the receipt shall be given and that after the giving and signing such receipts such purchaser shall not be in any way accountable for any loss or misapplication of the said purchase monies or any part thereof

And the meaning of me and his my will is that my said Trustee his Executors and Administrators shall and do pay apply and dispose of the monies which shall be raised by such sale or sales as follows, that is to say, equally amongst all my children (except my eldest son John who is amply provided for) share and share alike And I also appoint my said wife Frances Starbuck and my son Martin jointly Executrix and Executor of this my last will and Testament

And my will and meaning further is that my said Trustee shall indemnify himself from all expenses which he shall necessarily incur in the execution of the Trust hereby in him reposed Nor shall he be answerable for any monies that may be lost unless through his own wilful neglect or default

And lastly I hereby revoke all former wills by me made at any time before

I do hereby certify that on the second day of September in the year of our Lord 1826 Martin Starbuck of Hickling in the County of Nottingham labourer and the son and one of the joint Executors named in the last Will and Testament of John Starbuck late of Hickling aforesaid in the Diocese of York tailor deceased was sworn well and truly to execute and perform the same and that the whole of the goods chattels and credits of the said deceased within the Diocese of York do not amount in value to the sum of one hundred pounds
