This is the last Will and Testament of me Catherine Staddon of Hose in the County of Leicester Widow

I hereby revoke all former Wills by me at any time heretofore made

I appoint my Nephews Thomas Hoe Stevenson and John Joseph Stevenson Executors and Trustees of this my Will And I declare that all trusts and powers hereinafter reposed and vested in my Trustees may be exercised by the survivor of them or the heirs executors or administrators of such survivor or other the Trustees or Trustee for the time being of this my Will

Whereas under the Settlement made in contemplation of my marriage with my late husband the Reverend James Staddon dated the 31st day of January 1860 I have (subject to the estates therein limited to myself and my said husband during our joint lives and to the survivor for his or her life) a general power by any deed duly executed by me or by my last Will to appoint the use of the fee simple of certain freehold hereditaments situate at Hose in the said County of Leicester

Now in exercise of the said power and of every other power in anywise enabling me in this behalf I appoint the said hereditaments Unto and To the use of my Trustees Upon trust that my Trustees shall sell the same as soon as conveniently may be after my decease and shall stand possessed of the moneys produced by such sale after payment thereout of the expenses incurred in connection with such sale Upon the same trusts as are hereinafter declared concerning the moneys to be produced by the sale calling in and conversion of my residuary real and personal estate

And whereas under the said Indenture of settlement of the 31st day of January 1860 I have (subject to the trusts therein contained in favour of myself and my said husband during our joint lives and in favour of the survivor during his or her life) a general power of appointing by my last Will or any Codicil thereto the sum of Five hundred pounds and the investments for the time being representing the same thereby settled

Now in exercise of the said power given to me by the said settlement and of every other power in anywise enabling me in this behalf I direct the said sum of Five hundred pounds and the investments for the time being representing the same to be paid or transferred on the determination of the trusts prior to my said power of appointment To my Trustees Upon Trust that my Trustees shall get in and convert the same into money or such part of the moneys produced by such getting in and conversion and of such part thereof as shall consist of money after payment thereout of the expenses incurred in connection with such getting in and conversion upon the same trusts as are hereinafter declared concerning the moneys to be produce by the sale calling in and conversion of my residuary real and personal estate

I Devise and bequeath all my real and personal estate not hereby otherwise disposed of Unto my Trustees Upon Trust that my Trustees shall sell call in and convert into money the same or such part thereof as shall not consist of money and shall with and out of the moneys produced by such sale calling in and conversion and with and out of such part of my personal estate as shall consist of money pay my funeral and testamentary expenses and debts and shall stand possessed of the residue of the said moneys (hereinafter called “my trust funds”)

In trust for the following persons namely my Nephews Thomas Hoe Stevenson John Joseph Stevenson Thomas Burnett of Hickling in the County of Nottingham and my Nieces Catherine Ann Bishop Mary Jane Stevenson Sarah Maria Wells Barbara Truman Stevenson and Mary Squier to be equally divided between them as tenants in common and not as joint Tenants Provided Always that if any of them my said Nephews and Nieces shall die in my lifetime leaving issue the child or children of every or any Nephew or Niece so dying as aforesaid who being a son or sons shall attain the age of twenty one years or being a daughter or daughters shall attain that age or marry shall take and if more than one equally between them the share which his her or their parent would have taken of and in my trust funds if such parent had survived me

I devise all the estates vested in me as a Trustee or Mortgagee Unto my Trustees subject to the trusts and equities affecting the same respectively

In Witness whereof I have hereunto set my hand this twentieth day of May One thousand eight hundred and eighty one

Signed by the above named Testatrix as and for her last Will in the presence of us who in her presence at her request and in the presence of each other have hereunto subscribed our names as Witnesses the words “hereafter declared” on the second page hereof having been first erased with a pen and the word “one” between the seventh and eighth lines from the top of the third page hereof having been first interlined

This is a Codicil to the within written Will of me Catherine Staddon of Hose in the County of Leicester Widow

I revoke the bequest of a share of my residuary estate (including the property over which I have a power of appointment under my Marriage Settlement) to my Nephew Thomas Burnett and to my Niece Mary Squier in my said Will contained and instead thereof I bequeath to each of them the said Thomas Burnett and Mary Squier a Legacy of Fifty pounds

And in all other respects I confirm my said Will

On the thirtieth day of March 1894 Probate of this Will with a Codicil was granted at Leicester to Thomas Hoe Stevenson and John Joseph Stevenson, the Nephews, the Executors
