Thomas Smith of Scalford 1728 Will

In the Name of God Amen This Eight Day of December in the year of our Lord Xst 1727 I Thomas Smith of the Parish of Scalford in the County of Leicester being weak in Body but of a Sound & well disposed Memory (praised be God for it) do make this my last Will & Testament in Manner & Form following

I bequeath my Soul to God my Maker in hopes of a Gracious acceptance with Him only upon the account of Jesus Xt my Redeemer And my Body to the Ground to be buried with Xtian Burial at the discretion of my Executrix hereafter Named And as for that portion of Worldly Goods which it hath pleased God to entrust me with I bequeath them as followeth

Imprimis I give to my Eldest Son William, in consideration of his duty & Affection toward me, one Cow, and Heifer, & as I would that He should Have neither the Best nor the worst I expect my Wife & Himself to pitch upon two Neighbours to make the Choice

Item I give to my Wife that Tenement or House which I now Inhabit with the Hereditaments thereunto belonging, to be possest by Her whilst She continues a Widow, for immediately upon Her Second Marriage, I require that it shall go to my Eldest Son Willm or otherwise not to descend to Him the aforesaid Willm till her decease, and upon his taking possession of the abovesaid House I do Oblige Him to distribute equally amongst his two Brothers & Younger Sisters the Sum of Eight pounds

Item I do require that my Wife & Eldest Son jointly do, upon my Decease, pay to my Eldest Daughter Mary the Sum of Forty Shillings, moreover I desire that they may be in a particular manner kind to Her

Item I do desire that My Wife & Children that keep unmarried may live together but if my Daughters or each of them that are then unmarried should find an Inconveniency in living with their Mother or Eldest Brother I do require that they may have the privilege of a Separate Room viz the Parlour in the aforesaid House to live in

All the rest of my Goods and Chattels, after my just Debts & Funeral expences are discharged I give to my Wife, tho not to be possest by Her any longer than She continues in her Widowhood For upon Her Second Marriage or Decease I would have my Houshold goods (excepting the Copper which I give then to my Son) to be distributed at Her discretion amongst the Surviving Daughters

And I do appoint my aforesaid Wife executrix of this my last Will & Testament revoking all other Wills formerly by me made
