Catharine Smith of Saxelby 1834 Will

This is the last Will and Testament of me Catharine Smith of Saxelby in the County of Leicester Spinster

First I direct my just debts legacies funeral and testamentary expences be fully paid

I Give Devise and bequeath All my Messuages Cottages Closes Stables Land and Hereditaments situate in Melton Mowbray in the County of Leicester or elsewhere within the Kingdom of England and All my Personal Estate and Effects whatsoever and wheresoever (Subject to the payment of my just Debts legacies hereinafter bequeathed funeral and testamentary expences) unto the Neice Mary Hayes who now lives with me her Heirs executors administrators and assigns for ever

I Give unto my neice Lucy the wife of John Dalby of Abb Kettleby Blacksmith the Sum of One hundred pounds and Unto my nephew William Hayes of Pickwell labourer the Sum of One hundred pounds which legacies I will shall be paid to each of the legatees within twelve months after my decease by my Executrix

I Give unto my Great neice Ann Johnson of Saxelby aforesaid the sum of Fifty pounds to be paid to her when she attains her age of twenty one years but if she should happen to die under that age Then I will that the said sum of Fifty pounds shall sink in for the benefit of my Executrix

Also I Give unto William Hayes the son of the said Mary Hayes the sum of Fifty pounds to be paid when he attains his age of twenty one years but in case he should happen to die under that age Then I will that the said sum of Fifty pounds shall sink in for the benefit of my Executrix

I do hereby appoint my said neice Mary Hayes Sole Executrix of this my last Will and testament hereby revoking all others by me made

In Witness whereof I have hereunto set my hand and seal this twenty ninth day of August One thousand eight hundred and thirty three

Let a Probate be made to Mary Hayes of Saxleby in the County of Leicester Spinster the Sole Executrix named in the will of the deceased who died 25th December last

She having been duly sworn as well to the faithful Execution of the Will as that the testatrix’s Goods Chattels and Credits without deducting any debts owing by the deceased therefrom did not amount in value to the sum of two hundred pounds
