Andrew Smyth of Nether Broughton 1685 Will and Inventory

For as much as it is appointed for all men once to dye upon the sixt day of July in the yeare of our Lord one Thousand six hundred eighty and five I Andrew Smyth of Neather Broughton in the County of Leicester yeoman being sick and weake in body but of good & sound memory praysed be God for it do make & ordaine this my last Will & testament in manner as followeth

First I Commit my soule into the hands of Almighty God and my body to be buried and as for those worldly goods which it hath pleased God to bestow upon me I give and bequeath as followeth

Imp: I give unto my Son John Smyth the house & homestead the pasture Close and the ancient yard land with all the appurtenances thereunto belonging (my wife injoying her thirds out of it) to him & his heires forever

It: I give unto my said son John all that one oxgange of land meddow & pasture with all the appurtenances which I purchased of Richard Steele called the pen Close (my wife enjoying her Thirds also) upon this condition that he pay unto my daughter Elizabeth Smyth the sum of forty pounds when shee shall accomplish the age of one & twenty yeares and also that he pay unto my Son Andrew Smyth the sum of forty poundes when he shall bee one & twenty yeares of age and also that he pay unto my son Richard Smyth the sum of forty poundes when he shall be one & twenty yeares of age and also that he pay forty pounds unto my daughter Dorothy Smyth when shee shall be one & twenty yeares of age all which said sumes of money if my said son John do pay as aforesaid and see that they be decently brought up according to their quality then the said oxgange of land & Close I give to him & his heires for ever

But if my said Son John Smyth do neglect or refuse to pay the said summes as aforesaid then my will is that the said oxgange of Land with all the appurtenances & the little Close called the Pen Close shall be sold And I do hereby authorise & give power unto my Loving Neibours William Wright John Milner Richard Wright & Robert Jackson or the greater part of them to sell & confirme the same to the best advantage for the use of my Daughter Elizabeth my Son Andrew my Son Richard and my daughter Dorothy

It: I give unto my daughter Mary Smyth the sum of Thirty pounds to be paid by my executors hereafter named

And lastly I give unto Elizabeth my wife and unto John Smyth my son all the rest of my goods & Chattels & Cattle whatsoever they paying my debts legacies & funerall Charges and do hereby make them the executors of this my last will & testament
