John Shuttlewood of Scalford 1760 Will

The will says Shuttleworth throughout, but it should be Shuttlewood.  The end of his signature has been partly obliterated so that it is not possible to see what he wrote.

In the name of God Amen I John Shuttleworth of Goldsmith Grange in the Parish of Scalford in the County of Leicester Grasier being Sick and Weak but of sound mind memory and understanding do make and ordain this my last Will and Testament in manner and form following That is to say

First I commend my Soul into the hands of Almighty God who gave it in hopes of a Joyfull resurrection thro’ the alone meritts of my only Saviour and Redeemer Jesus Christ and my body to the Earth to be decently Interred at the Discretion of my Executors in Trust hereinafter named

And as to my Worldly Estate wherewith it hath pleased Almighty God to Intrust me with I dispose thereof as followeth (my Debts Legacies funerall Expences and the probat of this my last Will and Testament being first paid and Satisfied)

I give and bequeath unto my Daughter Elizabeth Shuttleworth the Sum of Fifty pounds of lawfull money of Great Britain to be paid her out of my personall Estate when she shall attain the Age of one and Twenty Years by my Trustees hereinafter mentioned

I Also give and bequeath unto my Son Henry Shuttleworth the Sum of Fifty pounds of like lawfull money out of my said personall Estate to be paid him by my said Trustees when he shall attain his said Age of one and Twenty Years and as to all the rest of my said personall [“estate” missing] whatsoever I shall Dye possessed of and not herein before by me bequeathed I give and bequeath unto my Son William Shuttleworth when he shall attain his Age of one and Twenty years

And for the true performance of this my last Will and Testament I nominate direct and Appoint my Trusty friends William Dunsmore of Scalford aforesaid and Thomas Oswyn of Scalford aforesaid Butcher and the Survivor of them and the Heirs Executors and Administrators of Such Survivor to be my Executors in Trust for the Sole use benefit and behoof of my said three Children

And I Do hereby Order and direct that my said Trustees should Manage the Farm that I now rent until such time as my said Son William Should attain his said Age of one and Twenty years if he shall so long live And my further mind and Will is that my said Trustees or the Survivor of them or the Executors or Administrators of Such Survivor shall not be Accountable for any Losses that shall or may happen about the Execution of this my last Will and also to reimburse themselves all such Just and necessary Expences as they shall be put unto in the Execution and performance of this my last Will and Testament

And my further Mind and Will is that if in case my said Daughter Elizabeth and Henry Shuttleworth shall think proper to live and cohabit with their Brother William Shuttleworth untill they shall attain their Severall ages of one and Twenty years that then and in such case I order and direct that my said Trustees shall find and provide for them all necessary Apparell Meat Drink Washing Lodging and proper education out of my said personall Estate untill such time as either or both them shall attain their respective Ages of one and Twenty years if in case they either think proper to live with him during such time and not otherwise

And if in case my said Son Henry Shuttleworth shall be desirous to be placed out to any Trade that he shall choose with the Approbation of my said Trustees that then and in such case I order and direct my said Trustees to put him out to such Apprenticeship and to pay such Master Such Sum or Sums of money as they can agree for out of the said Sum of Fifty pounds to him before by me bequeathed And also to find and provide for him all Such necessaries as shall be reasonably wanted during his sd Apprenticeship out of my said personall Estate

And my further mind and Will is that if in case one or more of my said Children shall depart this life before he she or they shall attain their Severall and respective Ages of one and Twenty Years that then the Share of him her or them so dyeing shall go to the Survivor of them And if in case they should all of them Depart this Life before they shall Attain their Severall and respective ages of one and Twenty Years then I give and bequeath my said personall estate that shall be then left unto my Brother in Law Francis Dodsley and my Sister in Law Jane Dodsley to be equally divided betwixt them share and share alike

And I do hereby Order and direct that my said Trustees and the Survivor of them and the Excors and Admors of Such Survivor to give and deliver up a true and Just account to Such person or persons whom it may concern According to the true Intent and meaning of this my last Will and Testament hereby revokeing all former Wills by me heretofore made

In Witness whereof I the said John Shuttleworth the Testator to this my last Will and Testament have hereunto set my hand and Seal the third day of June one thousand Seven hundred and Sixty
