In the Name of God Amen I Joel Shuttlewood of Wartnaby in the County of Leicester Grazier being Sick and Weak in Body But of Sound Mind Memory and Understanding and Considering the Uncertainty of this Life Do make and Ordain this my last Will and Testament in manner and form following (That is to say)

First of all I Give my Soul to God who Gave it me And my Body I Commit to the Earth to be Decently Interred at the Discretion of my Executor hereinafter named

And as for my Worldly Estate which hath pleased God to bless me with I Give and Dispose thereof as follows

In the First place I Give and Devise All that my Messuage or Tenement Homestead and New inclosed piece or parcell of Land with the Appurtenances Scituate Lying and Being in the Mannor or Lordship of Melton Mowbray in the said County of Leicester which I purchased of William Grocock And now in the Tenure or Occupation of William Mowbray or his Assignes unto my Son William Shuttlewood his heirs and Assignes for ever

And also I Give and Devise All that my Close of Meadow or pasture Ground with the Appurtenances Lying and being in the Mannor or Lordship of Burton on the Woulds in the said County of Leicester which I purchased of William Chester unto my Two Friends Thomas Wilburn of Thorpe Arnold in the said County of Leicester Grazier and Thomas Hall of Scalford in the said County of Leicester Farmer their heirs and Assignes To have and to hold the said Close of Meadow or pasture Ground and premisses unto the said Thomas Wilburn and Thomas Hall their heirs and Assignes To such uses upon such Trusts and to and for such intents and purposes and under and Subject to such Provisoes Limittacons and Agreements as are hereinafter mentioned Expressed and Declared of and Concerning the same (That is to say)

To the use and behoof of my Daughter Susannah Shuttlewood and her Assignes for and During the Term of her Natural Life And from and after the Determination of that Estate Then to the use and behoof of the said Thomas Wilburn and Thomas Hall their heirs and Assignes During the Life of my said Daughter Susannah Shuttlewood upon Trust to preserve the Contingent uses and Estates hereinafter Limitted from being Defeated or Destroyed and for that purpose to make Entries and bring Actions as the Case shall require But nevertheless to permit and Suffer my said Daughter Susannah Shuttlewood and her Assignes during her Life to Receive and Take the Rents and profits thereof to and for her own use and benefit And from and after her Decease then to the use and behoof of my said Son William Shuttlewood his heirs and Assignes for ever

Provided Always Nevertheless and my Mind and Will is That in case my said Daughter Susannah Shuttlewood Shall at any time after my Decease Intermarry with any Person whatsoever That then and imediately after such her said Marriage as aforesaid I then Order and Direct And do hereby Authorize and Empower the said Thomas Wilburn and Thomas Hall and the Survivor of them and the heirs and Assignes of such Survivor to Sell and Dispose of the said Close of Meadow or pasture Ground in Burton on the Woulds aforesaid and premisses for the best price that they or either of them Can Get for the same And the Monies Arising therefrom and thereby to pay and Dispose thereof in manner and form following (That is to say)

The Sum of One Hundred pounds part thereof to the intent and purpose That they the said Thomas Wilburn and Thomas Hall their heirs Extors and Admors Do and Shall As soon as may be thereafter place out the said Sum of One Hundred pounds at Interest upon Good Land Security or Securities And with the Interest and proceed thereof Do pay and Dispose unto my said Daughter Susannah Shuttlewood During the residue of her natural Life for her Sole Separate and peculiar use whose Receipt shall be a Good Discharge to the said Thomas Wilburn and Thomas Hall their heirs Extors and Admores Notwithstanding her Coverture And in nowise under the Controul or Disposal of such Person as my said Daughter Susannah Shall so Intermarry with and without being Subject to his Debts and Engagements And from and after her Decease Then to pay and Dispose of the said Principal Sum of One Hundred Pounds to and amongst all and every the Child and Children of my said Daughter Susannah by Equal Shares and proportions And in Case no such Child or Children issuing of her Body Then upon this Further Trust and Confidence That they the said Thomas Wilburn and Thomas Hall and the Survivor of them and the heirs Extors and Administrators of such Survivor Shall then pay and Dispose of the said principal Sum of One Hundred pounds unto my said Son William Shuttlewood his Extors and Admors

And as to for and Concerning the residue of the said purchase Money of the said Close and premisses They the said Thomas Wilburn and Thomas Hall their heirs Executors and Administrators Do and shall then pay and Dispose of the same unto my said Son William Shuttlewood his Executors or Administrators Any thing herein my said Will before Contained to the Contrary thereof in any wise Notwithstanding

Also I Give and bequeath unto my said Daughter Susannah Shuttlewood the Sum of Eight pounds to be paid her imediately after my Decease by my said Executor

Also I Give and bequeath unto my Son Joel Shuttlewood Not only the Sum of One Hundred and Fifty pounds to be paid him within Twelve Months next after my Decease by my said Executor But also my Stock and Cattle upon my Farm in Goadby Marwood in the said County of Leicester which I now Rent of George Tilden Esquire (Except Two Cowes One Little Heiffer and a Filley rising Two years Old) to be Delivered to him imediately after my Decease by my said Executor

And also I Give and bequeath unto my Son John Shuttlewood the Sum of Three Hundred pounds to be paid him within Twelve Months next after my Decease by my said Executor

And also I Give and bequeath unto my Grandaughers Elizabeth Kirk Mary Kirk and Anne Kirk and my Grandson William Kirk the Sum of Eighty pounds to be equably Divided amongst them Share and Share alike to be paid to them and the Survivors and Survivor of them When and As soon as they shall Severally and respectively Attain their Severall and respective Age and Ages of Twenty one years by my said Executor And my Mind and Will is that they my said Grandchildren shall be paid them and the Survivors and Survivor of them Interest for the same after the rate of Four pounds for One Hundred pounds by the year yearly untill they shall So Severally and respectively Attain their said Age and Ages of Twenty one years

And also I Give and bequeath unto my said Two Friends Thomas Wilburn and Thomas Hall their Extors and Admores the Sum of Three Hundred pounds Upon this Trust and Confidence That they the said Thomas Wilburn and Thomas Hall and the Survivor of them Do and Shall As soon as may be after my Decease put and place out the said last mentioned Principal Sum of Three Hundred pounds at Interest upon Good Land Security or Securities and with the Interest and proceed thereof Do and Shall pay and Dispose of the same unto my Son Richard Shuttlewood yearly and every year untill he shall Attain his Age of Twenty one years for his Maintenance and Apparell And when and As soon as he shall Attain his said Age of Twenty one years Then Do and shall pay and Dispose of the said last mentioned Sum of Three Hundred pounds unto my said Son Richard Shuttlewood for his use and benefit But in Case my said Son Richard Shuttlewood Shall Dye and Depart this Life before he Attains his said Age of Twenty one years Then upon this further Trust and Confidence That they the said Thomas Wilburn and Thomas Hall their Executors and Administrators Do and Shall then Pay and Dispose of the said last menconed Sum of Three Hundred pounds unto my said Son William Shuttlewood

And also I Give and bequeath unto my said Son Richard Shuttlewood the Sum of Three pounds to be paid him imediately after my Decease by my said Executor

And also I give and bequeath to my Daughter Sarah Moor the Sum of One Shilling to be paid her imediately after my Decease by my said Executor

And also I Give and bequeath unto my Daughter Elizabeth Marriott the Sum of Twenty pounds to be paid her imediately after my Decease by my said Executor

And also I Give and bequeath unto my Daughter Mary Shuttlewood the Sum of One Hundred and Fifty pounds to be paid her within Twelve Months next after my Decease by my said Executor

And also I Give and bequeath unto my Son Thomas Shuttlewood All and Singular my Household Goods Scituate and being in my now Dwelling House in Wartnaby aforesaid And all my Stock Cattle and Implements of Husbandry in and upon my Farm in Wartnaby aforesaid to be Delivered to him imediately after my Decease by my said Executor

And also I Give and bequeath unto the said Thomas Wilburn and Thomas Hall the Sum of Ten pounds to each of them as and for a Compensation for their Care and Trouble in the Execution of this my said Will

And Lastly All and Singular the rest residue and remainder of my Household Goods other Goods Stock Cattle Chattells rights Credits and personal Estate of What kind or Nature soever (my Debts legacies and Funeral Expences being first paid and Discharged) I Give and bequeath unto my said Son William Shuttlewood Whom I do hereby Appoint full and Sole Executor of this my last Will and Testament Revoking all former and other Wills by me at any time heretofore made

In Witness whereof I the said Joel Shuttlewood The Father and Testator have to this my last Will and Testament Contained and Written on Two Sheets of Paper Set my hand and Seal to each Sheet thereof this Twenty Second Day of March in the year of our Lord One Thousand Seven Hundred and Sixty Four
