William Shipman of Stathern 1841 Will

This is the last Will and Testament of me William Shipman the Elder of Stathern in the County of Leicester Grazier as follows

I Give and Devise All that Messuage or Tenement Outbuildings yard and homestead containing one Acre and an half or thereabouts in the occupation of John Shipman And also all those Closes or grounds inclosed containing Twenty Acres or thereabouts to situate standing lying and being in Stathern aforesaid called the Becks Close and the Black Ground unto my said Son John Shipman his heirs and Assigns for ever Subject to the payment of Three hundred pounds within Twelve months after my decease unto my Two Trustees namely my Son Andrew Shipman and my Son in Law Thomas Hilton Upon Trust to place the same out on good security and allow the Interest thereof to accumulate and added to the said Principal Sum until my Two Grandsons William Hilton and Thomas Hilton (the sons of William Hilton of Boothby in the County of Lincoln) shall attain their Respective Ages of Twenty one years And when and as they attain the same then Upon Trust to pay the said Sum of Three hundred pounds and the Interest thereof so to accumulate as aforesaid unto and between them my said Two Grandsons in equal shares But in case either of them shall happen to die under Age unmarried and without lawful Issue Then I will that the share of him so dying shall go to the Survivor his Executors or administrators

I Give unto my Said Son in law Thomas Hilton the Sum of Ten pounds to be paid to him by My said Son John within Six months after my decease

I Give and Devise All those Two Closes or Ground inclosed lying in the Lordship of Stathern aforesaid called the Sand holes and Cabbage Garden Closes containing together about Twelve Acres unto my Son Thomas Shipman his heirs and assigns for ever

I Give and Devise All those Two other Closes or Grounds inclosed lying in the said lordship of Stathern containing fifteen Acres or thereabouts called the Mill Hill and Upper furlong Closes Unto my said Son Andrew Shipman his heirs and assigns for ever

I Give and Devise All that my other Messuage or Tenement with the homestead and Appurtenances thereto belonging in Stathern aforesaid in the Tenure of Joshua Marriott unto my Two Grandsons Henry Shipman and William Shipman (the Children of my late Son William Shipman) their heirs and assigns for ever to take and enjoy the same as Tenants in common and not as joint Tenants Subject to a Chief Rent of five shillings

I Give and Devise All those two other Closes or Grounds inclosed in Stathern aforesaid with their appurtenances containing Twelve Acres or Thereabouts called Willow Close and far Sand Pit hill unto my said Two Grandsons Henry Shipman and William Shipman their heirs and assigns for ever to take and enjoy the same as Tenants in common and not as joint Tenants Provided that in case either of my said Two Grandsons shall happen to die under the Age of Twenty one years unmarried and without lawful issue Then I Give the part or Share of the said Two Closes of him so dying unto my said Two Sons Andrew Shipman and Thomas Shipman their heirs and Assigns for ever as Tenants in common and not as joint Tenants

I Give All the Residue and Remainder of my Personal Effects whatsoever unto my said Son John Shipman and appoint him Sole Executor of this my last Will and Testament hereby Revoking all former Wills by me made

In Witness whereof I have hereunto set my hand and Seal this Eighth day of September one thousand eight hundred and Twenty Eight

Signed sealed published and declared by the said Testator as and for his last Will and Testament in the presence of us who have at his Request in his presence and in the presence of each other set out hands as witnesses to the due Execution thereof

John Shipman of Stathern in the County of Leicester Grazier the sole Executor in this will named was duly sworn to the truth & faithful performance thereof as usual and that the goods chattels and credits of the deceased without deducting debts owing by him therefrom do not amount in value to the sum of fifty pounds and that the deceased died on the eleventh day of February last
