This is the last Will and Testament of me Andrew Shipman of Stathern in the County of Leicester Farmer

I do hereby revoke all former Wills and testamentary dispositions by me at any time heretofore made

I appoint my three Nephews William Shipman of Harby Thomas Shipman of Croxton Lodge and Andrew Shipman of Stoughton Grange (hereinafter called “my Trustees”) to be the Executors and Trustees of this my Will and I declare that all trusts and powers hereinafter reposed and vested in my Trustees may be exercised by the survivors or survivor of them or the heirs executors or administrators of such survivor or other the Trustees or Trustee for the time being of this my Will

I devise all Estates vested in me as a Trustee or Mortgagee unto my Trustees their heirs and assigns subject to the trusts and equities affecting the same respectively

I bequeath to my Wife Ellen all my furniture plate linen books brewing vessels and all other my household effects and a Legacy of Fifty pounds to be paid to her at the expiration of one calendar month from my death

I bequeath all my personal Estate not hereinbefore otherwise disposed of Unto my Trustees Upon Trust that my Trustees shall sell call in and convert into money the same or such part thereof as shall not consist of money and shall with and out of the moneys produced by such sale calling in an conversion and with and out of such part of my personal estate as shall consist of money pay my funeral and testamentary expenses and debts and the above mentioned Legacy and shall invest the net residue of the said moneys and pay the annual income arising therefrom to my said Wife during her life

I devise all my Real Estate to my said Wife for her life and after her death I dispose of my Real Estate as follows (that is to say)

I devise my Close of Land with the appurtenances thereto belonging which I purchased of William Gratton and the Messuage and premises late in the occupation of Mrs Sarah Frisby situate in Stathern aforesaid Unto and To the use of the said Thomas Shipman of Croxton Lodge his heirs and assigns for ever and I devise all that my Messuage or Tenement with the outbuildings homestead orchard and Closes of Land thereto belonging containing in the whole fifteen acres or thereabouts situate in Stathern aforesaid which were devised to me by my late Father and also All my Closes of Land situate in Stathern aforesaid with the appurtenances thereto containing Eighteen acres or thereabouts which I purchased of Thomas Roberts and all other my Real Estate situate in the Parish of Stathern aforesaid (except what I have hereinbefore otherwise disposes of) Unto and To the use of my said Nephew Andrew Shipman his heirs and assigns for ever subject to and charged with the payment of the sum of One thousand four hundred pounds to my Trustees at the expiration of Twelve calendar months after the decease of the survivor of me and my said Wife

And I devise all my share estate and interest in a Farm situate in the Parish of Harby in the County of Leicester and all other my Real Estate not hereinbefore otherwise disposed of Unto and To the use of my Trustees their heirs and assigns Upon Trust to sell the same as soon as conveniently may be after the decease of my said Wife And I declare that my Trustees shall from and after the decease of my said Wife stand possessed of the moneys produced by the sale calling in and conversion of my residuary personal Estate or the investments for the time being representing the same and of the said sum of one thousand four hundred pounds and of the moneys produced by the sale of my residuary Real Estate (hereinafter referred to as “my residuary trust funds”) Upon Trust at the expiration of Twelve calendar months after the decease of the survivor of me and my said Wife to pay or retain thereout the following Legacies (that is to say)

To the children of my late Nephew William Shipman of Waltham on the Wolds the sum of Six hundred pounds to be equally divided between such of them as shall attain the age of Twenty one years or marry under that age

To my Nephew Thomas Shipman of Grantham the sum of Four hundred pounds

To each of the four Sons now living of my Wife’s Nephew John Snodin the sum of Nineteen Guineas

To each of the daughters now living of my late Nephew Henry Shipman of Stathern the sum of Fifty pounds

To Miss Handley who formerly lived with me the sum of Ten pounds

And to my Trustees the sum of Four hundred pounds to be held by them Upon the Trusts hereinafter declared concerning the same and subject to the payment of the foregoing Legacies

I declare that my Trustees shall stand possessed of my residuary trust funds In trust for my Nephews the said William Shipman of Harby and Thomas Shipman of Croxton Lodge and my Niece Sarah Robinson to be equally divided between them share and share alike

I also declare that my Trustees shall hold the before mentioned sum of Four hundred pounds Upon the Trusts following (that is to say)

Upon Trust to invest the same with power from time to time at their discretion to vary the investments and to pay the income arising therefrom to Ann Shipman the Wife of my Nephew William Shipman of Stathern during her life for her sole and separate use without power of anticipation and from and after her death Upon Trust as to as well the capital as the income thereof for all the children or the only child of my said Nephew William Shipman of Stathern who being Sons or a Son attain the age of Twenty one years or being Daughters or a Daughter attain that age or marry and if more than one in equal shares

I bequeath to my Servant Sarah Shelton if she is in my service at the time of my death but not otherwise a Legacy of Ten pounds and direct that the same shall be paid out of my residuary Personal Estate

Proved at Leicester on the Twenty fourth day of November 1882 by the Oaths of William Shipman Thomas Shipman and Andrew Shipman, the Nephews, the Executors, to whom Administration was granted

The Testator Andrew Shipman was late of Stathern in the County of Leicester Farmer and died on the Tenth day of April 1882 at Stathern aforesaid
