William Shillcock of Frisby on the Wreake 1840 Will

This is the last Will and Testament of me William Shillcock the Elder of Frisby on the Wreake in the County of Leicester Farmer and Grazier

I direct all my just debts funeral and Testamentary expences to be fully paid

I Give Devise and bequeath All my Messuages Lands hereditaments and Real Estate situate at Hose in the said County or Elsewhere and all other my Real Estate And also All my Personal Estate of every description of which I shall die possessed Unto my Three Trustees Henry Shillcock of Stathern Beaumont Shillcock of Hose and John Berridge of Frisby aforesaid Graziers their heirs executors administrators and assigns Upon Trust to manage the same in the best manner possible for the benefit of my Wife Mary Shillcock and for the benefit and advantage of all my Children now born or to be born in due time after my decease Until my Son William attains his full age of Twenty one years

Then I Give Devise and bequeath all my said Real and Personal Estate and Effects unto my Said Son William Shillcock his heirs executors administrators and assigns for ever Subject nevertheless to the payments hereafter chargeable thereout and thereupon

I Give and Devise to my affectionate Wife Mary Shillcock and her assigns for and during the Term of her natural life One Annuity or clear yearly sum of Forty Pounds of lawful English money to be paid half yearly on the Sixth day of April and the Eleventh day of October in every year the first payment to be made on such of the said days as shall first happen after my said Son attains his majority

I Give to my daughter Ann Shillcock the legacy or Sum of Seven hundred pounds to be paid to her at the Age of Twenty one Years

I Give to the Child or Children of which my said Wife is now pregnant the Sum of Five hundred pounds to be paid to him her or them at the Age of Twenty one years

And I do appoint the said Henry Shillcock Beaumont Shillcock and John Berridge Joint Executors of this my last Will and Testament hereby Revoking all former wills by me made

Provided and my will expressly is that in case my said Trustees or the Survivors or Survivor of them should consider it would be greatly to the Advantage of my family that my said Real Estate or any part thereof should be disposed of Then and in such case I do hereby authorize them to sell the same or any part thereof in such manner as they may think proper and with the monies arising therefrom to invest the same for the benefit of my said Wife and Children until my said Son William Attains his Age of Twenty one years when the same shall be paid to him subject to the said legacies and Annuity

And for facilitating the sale of my said Estate or any part thereof I do hereby declare that the Receipt or Receipts of my said Trustees or the Survivors or Survivor of them or his heirs shall be good and sufficient discharge and discharges to Such purchaser or purchasers who shall not be obliged to see to the application or be answerable for the loss misapplication or non application thereof

And Lastly I further will that my said Trustees be at liberty to Retain out of the said Trust monies and premises all necessary expences they may be at or put to in executing the said Trusts and that neither of them shall be answerable for any thing except his own wilful neglect or default not one for the other but each for his own acts deeds neglects and defaults only

Signed sealed published and declared by the said Testator William Shillcock as and for his last Will and Testament in the presence of us who have at his Request in his presence and in the presence of each other set our hands as witnesses to the due Execution thereof
