Joseph Shilcock of Hose 1787 Will

This is the Last Will and Testament of me Joseph Shilcock of Hose in the County of Leicester Farmer and Grazier

First I devise that all and every my just debts and Funeral Expences may be first paid and discharged

Also I Give and bequeath unto my two Brothers William Shilcock and Henry Shilcock the sum of One thousand pounds Upon this Special Trust and Confidence that they my said Trustees William Shilcock and Henry Shilcock and the Survivor of them his Executors or Administrators do and shall as soon as conveniently may be after my decease put and place the said sum of one thousand pounds out at Interest upon one or more good and sufficient Security or Securities and with the Interest arising therefrom yearly and every year pay and apply the same for the maintenance and Education of my five Daughters Mary Shilcock Ann Shilcock Elizabeth Shilcock Hannah Shilcock and Alice Shilcock until they severally and respectively attain their several and respective Age and Ages of Twenty one years And when and so soon as my said five Daughters shall attain their respective Age and Ages of Twenty one years Then I do direct my said Brothers and Trustees and the Survivor of them his Executors or Administrators to pay the said sum of one thousand pounds and all interest that shall be then due for the same unto and amongst my said five Daughters share and share alike But my mind and Will is that in case my Wife Mary Shilcock shall happen to be Pregnant of any Child or Children at the time of my decease Then I do empower my said Trustees William Shilcock and Henry Shilcock and the Survivor of  them his Executors or Administrators to pay such sum or sums of money either by deducting the same or any part thereof out of the said sum of one thousand pounds hereinbefore by me given to my said Brothers In Trust as aforesaid Or by deducting the same or any part thereof out of the Personalty hereinafter given and bequeathed to my said Brothers In Trust for my Son Joseph Shilcock as they my said Trustees or the Survivor of them his Executors or Administrators shall in his or their own discretion think proper and convenient the same to be paid as soon as convenient may be after such Child or Children shall happen to be born

And my mind and Will is that my said Trustees and the Survivor of them his Executors or Administrators do and shall put and place the same Contingent sum or sums of money out at Interest upon one or more good and sufficient Security or Securities and the interest arising therefrom yearly and every year pay and apply the same for the Maintenance and Education of such other Child or Children whereof my said Wife may be Pregnant at the time of my death until he she or they shall several and respectively attain to his her or their age and ages of twenty one years And when and so soon as he she or they shall attain their respective Age and ages of Twenty one years Then I do direct my said Trustees and the Survivor of them his Executors or Administrators to pay such Contingent sum or sums of money and all Interest that shall be then due for the same unto such after born Child or Children in equal shares Provided always that in case any one or more of my said five Children or any after born Child or Children shall happen to die before he she or they shall attain to the Age of Twenty one years Then I do direct my said Brothers William Shilcock and Henry Shilcock and Survivor of them his Executors or Administrators to pay the share or shares of him her or them so dying unto the Survivors or Survivor of them my said Children or unto my said Son Joseph Shilcock Or in such parts shares and proportions as they my said Brothers and the Survivor of them his Executors or Administrators shall in his or their discretion think proper

And also I Give and bequeath unto my said Wife Mary Shilcock one Annuity or clear yearly sum of fifteen pounds free and clear of all deductions whatsoever, provided she continues my Widow and not otherwise But in case she intermarries with any Person of persons whomsoever then I Give and bequeath unto my said Wife Mary Shilcock One Annuity or clear yearly sum of ten pounds only the same to be paid by two half yearly payments in the year (that is to say) the tenth day of October and the fifth day of April the first payment thereof to begin and be made on such of the said days of payment as shall first happen after my decease And I give and devise All that Messuage Cottage or Tenement with the Yard Garden Orchard Outbuildings and appurtenances thereunto adjoining and belonging situate at Hose aforesaid and in the possession of Samuel Sumner (expectant on the decease of my Mother Alice Shilcock) unto my said Wife Mary Shilcock for and during the term of her natural life Provided she continues my Widow and not otherwise And in case my said Wife intermarries with any Person or Persons whomsoever as aforesaid Then I Give and devise the said Hereditaments and premises and every part thereof unto my said Son Joseph Shilcock his heirs and Assigns for ever Provided always that in case my said Wife Mary Shilcock and my said Son Joseph Shilcock shall agree to dwell and reside together without her making any Satisfaction for such her Residence and Abode Then my Will is that as well the said Annuity As also the Contingent life Estate of and in the said Messuage Cottage or Tenement and premises hereinbefore by me given to my said Wife shall be null and void to all intents and purposes

Also I Give and bequeath all my Household Goods other Goods Stock Cattle Chattels Crops of Grain and Hay Implements of Husbandry Ready money and Securities for money and all other my Personalty whatsoever (after payment of my debts Legacies Annuity and Funeral Expences) unto my said Brothers William Shilcock and Henry Shilcock Upon this Special Trust that they my said Trustees and the Survivor of them his Executors or Administrators do and shall immediately after my decease enter into  the possession of my said Personal Estate and premises Together with the farm now in my possession and which I Rent of the Most Noble Charles Duke of Rutland (Humbly requesting of His Grace to accept them Tenants as Trustees as aforesaid) and take upon themselves the Management and Execution thereof untill my said Son Joseph Shilcock shall attain to his Age of Twenty one years And the interest and profits arising therefrom (after payment of Rent and all other Expences that may be incurred in the Management and Execution of the Trusts hereby reposed in my said Trustees) yearly and every year to pay and apply the same for the Maintenance Education and benefit of my said Son Joseph Shilcock And when and as soon as my said Son shall attain to the Age of Twenty one years Then my Will is that my said Trustees and the Survivor of them his Executors or Administrators shall and do relinquish and give up the possession of the said farm together with my said Household Goods other Goods Stock Cattle Chattels Crops of Corn Grain and Hay Implements of Husbandry and all other my Personalty whatsoever with the benefits and profits arising therefrom to my said Son Joseph Shilcock for his own proper use and benefit (Subject nevertheless and chargeable with my debts Legacies Annuity and Funeral Expences as aforesaid) But my mind and Will is that in case my said Son Joseph Shilcock shall happen to die before he attains his said Age of Twenty one years and any of such after born Child or Children shall happen to be a Son or sons Then I do direct my said Trustees and the Survivor of them his Executors or Administrators to pay and apply the Interest and profits of my said Farm and Personalty to and for the Maintenance Education and benefit of such Son or sons until he or they shall respectively attain to his or their Age and ages of Twenty one years and when and as soon as he or they shall so attain to his or their Age and ages of Twenty one years Then my Will is that my said Trustees and the Survivor of them his Executors or Administrators do and shall give up as well the possession of the said farm as also my said Household Goods other Goods Stock Cattle Chattels Crops of Corn Grain and Hay Implements of Husbandry and all other my Personalty whatsoever together with all benefit and profits arising therefrom (subject and chargeable as aforesaid) unto such after born son or sons share and share alike Provided further that in case there be no after born son or sons Or if so, such Son or sons shall happen to die before he or they shall attain to the Age of Twenty one years Then my will further is that my said Trustees and the Survivor of them his Executors or Administrators do and shall pay  and apply the interest and profits of my said Farm and Personalty to and for the Maintenance and Education of all and every my Daughter as well now born as hereafter to be born untill my Daughters shall attain to the Age of Twenty one years and when and as soon as my said youngest Daughter shall attain her said Age of Twenty one years Then I do direct my said Trustees William Shilcock and Henry Shilcock and the Survivor of them his Executors or Administrators to relinquish and give up the possession of the said Farm together with my Household Goods other Goods Stock Cattle Chattels Crops of Corn Grain and Hay Implements of Husbandry and all other my Personalty whatsoever and all benefit and profits arising therefrom unto and among all and every my Daughters as well now born as hereafter to be born for her and their own proper use and benefit in equal shares and proportions Provided always nevertheless and my mind and will further is that it shall and may be lawful unto and for my said Trustees and the Survivor of them his Executors or Administrators to deduct and reimburse to himself and themselves out of the Trust Estate and premises all such Costs Charges Damages and Expences as they or the Survivor of them his Executors or Administrators shall or may be put unto in Execution of the Trusts hereby in them reposed

And Lastly I do hereby appoint my said Brothers William Shilcock and Henry Shilcock joint Executors of this my Last Will and Testament hereby revoking all other Wills by me heretofore made

In Witness whereof I the said Joseph Shilcock the Testator have hereunto set my hand and seal this Sixteenth day of August in the year of our Lord one thousand seven hundred and eighty six
