Ann Rouse of Hose 1831 Will

This is the last Will and Testament of me Ann Rouse of Hose in the County of Leicester Widow that is to say

Whereas my late son in Law Thomas Barlow stood indebted to me on his Note of Hand at the time of his decease in the sum of fifty pounds Now I do hereby release and discharge the said debt and acquit and release the executors and administrators of the said Thomas Barlow and also my daughter Mary Barlow his Widow and all other persons who is or may be liable to pay the same from the payment of the said debt and interest and every part thereof

And whereas my son in Law John Whittle of Harby in the said County stands indebted to me in the sum of one hundred pounds Now I do hereby give and bequeath the sum of fifty pounds part thereof to my daughter Elizabeth the Wife of the said John Whittle and the remaining sum of fifty pounds other part thereof to my daughter Eleanor Perkins to be paid within six calendar months next after my decease

All the rest residue and remainder of my personal estate whatsoever and wheresoever I give and bequeath unto James Stokes of Hose aforesaid Grazier and John Pears of Claxton otherwise Long Clawson in the said County Victualler their executors and administrations Upon trust to convert the whole into money and stand possessed thereof upon the several trusts hereinafter mentioned

I give and devise all my real estate whatsoever and wheresoever with the rights members and appurtenances thereto belonging unto and to the use of the said James Stokes and John Pears their heirs and assigns for ever Upon trust nevertheless and to the intent and purpose that they the said James Stokes and John Pears the survivor of them or the heirs or assigns of such survivor do and shall with all convenient speed after my decease sell convey and dispose of the said real estate hereditaments and premises either by public auction or private contract together or in parcels as they or he shall think best for the most money and at the best price and prices that can be reasonably had or gotten for the same

And I do hereby declare my mind and will to be and direct accordingly that the receipt and receipts of the said James Stokes and John Pears or the survivor of them or the heirs or assigns of such survivor signed by them or him shall be a good and sufficient discharge and discharges to the purchaser or purchasers of the said real estate hereditaments and premises or any part or parts thereof for so much of the purchase money for which such receipt or receipts shall be given And that after the giving and signing such receipt or receipts such purchaser or purchasers his or their heirs or assigns shall not be obliged to see to the application of the said purchase monies or be answerable or accountable for any loss misapplication or nonapplication of the same or any part or parts thereof

And upon further trust that the said James Stokes and John Pears or the survivor of them or the heirs or assigns of such survivor shall and do pay apply and dispose of the money which shall be raised by such sale or sales and which I hereby declare shall be considered as part of my personal estate in manner hereafter mentioned

And my will and meaning is and I do hereby expressly direct that the said James Stokes and John Pears and the survivor of them and the heirs executors and administrators of such survivor shall stand and be possessed of and interested in the monies to arise from the sale of my real estate as aforesaid and the rents and profits thereof in the mean time from and after my decease until the same shall be sold And also the residue and remainder of my said personal estate which I will shall form one united fund Upon trust in the first place to pay off and discharge all mortgages and other incumbrances charged upon or affecting my said real estate hereditaments and premises and the expences of my said Trustees in the execution of the trusts hereby in them reposed

In the next place to pay and discharge all my other debts funeral and testamentary expences

And after payment and satisfaction thereof do and shall pay and dispose of the residue thereof in manner following that is to say

I give and bequeath to my son James Rouse the sum of thirty pounds part thereof

To my niece Frances Glen the sum of ten pounds

To my grandson Thomas Hardy the like sum of ten pounds

To my granddaughter Ann the daughter of my son John Rouse the sum of twenty pounds

And to my granddaughter Ann the daughter of my son Thomas Rouse the sum of ten pounds

I give and bequeath to my grandson John Rouse the son of my son Joseph Rouse the sum of forty pounds to be paid to him when and as soon as he shall attain the age of twenty one years the interest thereof in the mean time to be paid to his mother Susannah Rouse and In case he shall die without issue under the said age of twenty one years then I give and bequeath the said sum of forty pounds to his sister Ann Rouse And in case both of them the said John Rouse and his said sister Ann Rouse shall depart this life under the age of twenty one years without issue then I give the said sum of forty pounds unto their mother the said Susannah Rouse for her own use

All the rest residue and remainder of the said monies I give and bequeath unto and equally between my daughter Eleanor Perkins and my daughter Elizabeth Whittle share and share alike

I appoint the said James Stokes and John Pears joint Executors of this my Will And my will and meaning is that my said Trustees and Executors and their respective heirs executors administrators and assigns shall and lawfully may by and out of the monies which shall come to their respective hands by virtue of the trusts aforesaid retain to and reimburse themselves respectively all such loss costs charges and expences as they or either of them shall or may sustain expend disburse or be put unto for or by reason or on account or in execution of the trusts hereby in them reposed or any thing relating thereto

And further that they shall not be answerable or accountable for any monies to be by them or either of them placed out at interest or deposited for safe custody or otherwise that may be lost unless it be through their or his own wilful neglect or default

And that my said Trustees and Executors shall not be answerable or accountable the one for the other of them or for the acts receipts neglects or defaults of the other of them but each of them only for his own separate acts receipts neglects and defaults

Lastly I hereby revoke and make void all former and other Wills by me at any time heretofore made and do declare this to be my last Will and Testament

In witness whereof I the said Ann Rouse the Testatrix have to this my last Will and Testament contained on this and the two preceding sheets of paper set my hand and seal to wit my hand to the two preceding sheets and my hand and seal to this third or last sheet thereof the Twenty first day of April in the year of our Lord one thousand eight hundred and thirty

Let a probate be made to James Stokes of Hose in the County of Leicester Grazier and John Pears of Claxton otherwise Long Clawson in the same County Victualler the joint Executors named in the Will of the deceased who died in the Month of [blank] last

They having been duly sworn as well to the faithful Execution of the Will as that the Goods chattels and Credits of the Testatrix without deducting any debts due and owing by her therefrom do not amount in Value to the Sum of Two hundred Pounds
