Thomas Roberts of Stathern 1811 Will

This is the last Will and Testament of me Thomas Roberts of Statherne in the County of Leicester Farmer as follows

First I will and direct that all my just Debts Funeral and Testamentary Expences be fully paid and satisfied

Then I Give and Devise unto my only son Robert Roberts All that my Messuage or Tenement wherein I now dwell with the Orchard and Appurtenances thereunto adjoining and belonging containing by Estimation One Acre more or less And also two Closes adjoining each other called or known b y the name of the Moor Closes containing together Forty three Acres two roods and Seventeen Perches (more or less) which said premises are situate and being in Statherne aforesaid and are subject to the sum of One hundred and fifty Pounds secured on Mortgage granted by my late Father Robert Roberts deceased of the said Estate or some part thereof

And also All that my Freehold allotment or parcel of land (divided into two Closes) containing Eleven Acres one Rood and thirty seven Perches (more or less) situate lying and being in Long Bennington in the County of Lincoln And also all that my Copyhold allotment or parcel of land in Long Bennington aforesaid containing two Roods (more or less) adjoining to the said freehold Allottment Together with the Appurtenances to the said Lands respectively belonging To hold to him my said Son Robert Roberts his heirs and assigns for ever he or they paying thereout unto my Daughters Elizabeth and Judith the sum of Two hundred Pounds apeice at the expiration of Twelve Months after my decease and unto my Daughters Ann Alice Sarah And Jane the like sum of Two hundred pounds apeice to be paid to them in case they are under the Age of Twenty one years at the time of my decease when and as they severally attain their respective Ages of Twenty one years with lawful Interest for the same to commence immediately after my decease But in case they or any of them shall have attained her or their Age or Ages or Twenty one Years in my life time then to be paid to such of them as shall have so attained that Age within twelve Months after my decease

I Give and bequeath unto my Daughter Mary the Wife of Edward Morrell of Harby in the said County of Leicester Cordwainer the sum of Two hundred pounds which I will shall be paid to her within twelve months after my decease out of my Real Estate hereinbefore given and devised to my said Son Robert Roberts But in case my said Daughter Mary Morrell shall happen to die before the said legacy shall become due and payable Then I will and direct that the said legacy of Two hundred pounds shall be paid unto and amongst all and every the Child and Children of my said Daughter Mary Morrell in equal shares and proportions

And I hereby also charge and make chargeable all my said Estates hereinbefore devised unto my said Son Robert Roberts with the just and true payment of the sum of Two hundred pounds apeice hereinbefore bequeathed to each of my Daughters Elizabeth, Judith, Ann, Alice, Sarah and Jane Roberts Provided nevertheless and my will is that if one or more of my said Daughters shall happen to die before her or their legacy or legacies shall by virtue of this my Will become payable and without Issue then I Give and bequeath the legacy or legacies of her or them so dying together with any Interest in respect of the same unto the Survivor or survivors of them if more than one share and share alike but any of my said Daughters so dying and leaving Issue her or their legacy or legacies to go to her or their respective Issue

I Give and Devise All that my Messuage or Tenement with the Orchard and Appurtenances thereunto belonging situate and being in Statherne aforesaid purchased of Richard Beet and now or late in the tenure of Occupation of Robert Dyer his Undertenants or assigns Unto my dear Wife Alice Roberts and her assigns for and during the term of her natural life and from and immediately after her decease I Give and devise the said last mentioned messuage or Tenement with the Orchard and Appurtenances thereunto belonging unto my said Son Robert Roberts his heirs and assigns for ever

Also I Give unto my said Wife Alice Roberts One Annuity or yearly rent charge of Twenty Pounds of lawful money of Great Britain to be issuing and arising out of the lands tenements and hereditaments in Stathern aforesaid which I hold or am entitled to for three lives and which are subject to a Mortgage granted by me for three hundred pounds and to be payable and paid to her my said Wife or her assigns for her life free and clear from all manner of deductions whatsoever either for Taxes or otherwise by two equal half yearly payments that is to say at Lady day and Michaelmas day in every year by even and equal portions the first payment to be made on such of the said days as shall first and next happen after my decease with such powers of Entry and Distress upon and perception of the rents and profits of the said lands tenements and hereditaments charged with the said Annuity or yearly rent charge in case of default of payment thereof or of any part thereof for the space of twenty days next after either of the said days appointed for Payment thereof as are usual in Cases of Rent charges

And subject to the payment of the said Annuity or yearly rent charge and the remedies and powers for receiving and recovering the same I Give and Devise my said lands tenements and hereditaments charged therewith unto my said Son Robert Roberts his heirs and assigns for ever

Also I Give and Devise unto my said Son Robert Roberts All that my Copyhold Messuage Cottage or Tenement with the homestead containing three roods and Eight Perches and other the appurtenances thereto belonging situate and being in Long Bennington aforesaid and now are or late were in the tenure or occupation of Matthew Scrimshaw his undertenants or assigns To hold to him my said Son Robert Roberts his heirs and assigns for ever

Also I Give and bequeath unto my three Grand Children Thomas Ann and Robert Roberts the Children of my last Son Thomas Roberts the sum of fifty Pounds Apeice which I will shall be paid to them and each of them when they shall severally attain to the Age of Twenty one years and I do hereby subject and charge all my Personal Estate with the payment thereof But in case any or either of my said Grandchildren shall happen to die before he she or they shall attain to the Age of twenty one years Then I will and direct that the share or shares of him her or them so dying shall sink into the residuum of my Personal Estate for the benefit of the Person or Persons entitled thereto

And I appoint my Brother Robert Roberts of Long Bennington aforesaid And my friend William Shipman of Statherne aforesaid Farmers Guardians for such of my Children and Grandchildren as shall be under the Age of Twenty one years at my decease and I direct that the Interest of their or her legacies shall be paid to them the said Robert Roberts and William Shipman and be by them applied for and towards the maintenance and Education of my said Child or Children or Grand Children during her or their minorities in such manner as to them shall seem necessary

All my Goods Chattels ready money securities for money and all other my Personal Estate and Effects of what nature of kind soever the same may be subject to the payment of my debts and funeral expenses I Give and bequeath unto my said Son Robert Roberts his Executors and Administrators And I do hereby nominate constitute and appoint my said Son Robert Roberts Sole Executor of this my last Will and Testament hereby revoking all former Wills by me made

In witness whereof I the said Thomas Roberts the Testator have to this my last Will and Testament contained in three Sheets of Paper to the two first Sheets thereof set my hand and to the third and last Sheet my hand and Seal the first day of August in the Year of our Lord One thousand eight hundred and Eleven

Signed sealed published and declared by the said Thomas Roberts the Testator as and for his last Will and Testament in the presence of us who have at his request in his presence and in the presence of each other set our hands as witnesses to the due Execution thereof the interlineation between the ninth and tenth lines from the bottom of the second sheet being done before the Execution thereof

Let a probat be granted to Robert Roberts & Wm Shipman joint Guardians within named (the Executor within named being dead since the death of the Father)

The above Robert Roberts and William Shipman being duly sworn as well to the faithful execution of the Will as that the Testator’s Goods Chattels & Credits do not amount in value to the sum of six hundred pounds

Bond, bound Judith Roberts spinster of Stathern, Anne Roberts spinster of Stathern, Robert Roberts gentleman of Long Bennington Lincolnshire and William Shipman grazier of Stathern, £1,000 20 September 1811.  Robert Roberts Sole Executor and Residuary Legatee survived the Testator but died a bachelor and intestate without having proved the will leaving a surviving mother who is also since dead.  If above bound Judith and Anne Roberts sisters and next of kin and Administratrixes of the will to produce and inventory and administer will.

Let Administration with the will annexed of all and singular the Goods Chattels and Credits of the within named Thomas Roberts deceased be granted and committed under Seal to the within bound Alice Roberts the Widow and lawful Relict [interlined] Judith Roberts & Anne Roberts the natural and lawful daurs and two of the next of kin [end of interlineation] of the said deceased and Administrarixes of the within named Robert Roberts deceased

They being duly sworn as well to the faithful Administration of all and singular the Goods chattels and Credits of the said deceased according to the tenor and Effect of the said Will as that the said Goods Chattels and Credits as they were at his death without deducting any debts owing by the deceased therefrom do not amount in Value to the Sum of Six hundred Pounds
