Jonathan Roberts of Scalford 1829 Will

This is the last Will and Testament of me Jonathan Roberts of Scalford in the County of Leicester Victualler as Follows

First I direct all my just debts funeral and Testamentary Expences to be fully paid

I Give and Devise All my Messuages Cottages Closes Lands Tenements hereditaments and Real Estate whatsoever situate and being in the Parish and Lordship of Scalford or elsewhere within the Kingdom of England with their appurtenances And also all my Personal Estate of Effects whatsoever and wheresoever and of what nature or kind the same may be of which I shall die possessed unto my Two friends Gregory Marriott and John Morris the Younger both of Scalford aforesaid Graziers their heirs executors administrators and assigns for ever Upon Trust to permit and suffer my affectionate wife Ann Roberts and her assigns to receive the rents and issues and profits of my said Real Estate and premises and have the free use and enjoyment of my said Personal Estate and Effects during the Term of her natural life for her own use and benefit

And from and immediately after her decease Then I Give and Devise All that my windmill together with the Paddock thereto adjoining And also all that Close or Ground inclosed containing Two acres or thereabouts called Easons Close adjoining the said Paddock in the Lordship of Scalford aforesaid in my own occupation and the South part of the orchard in the village of Scalford aforesaid to the wadd stones unto my Son George Roberts his heirs and assigns for ever

Subject nevertheless to the payment of the Sum of One hundred pounds to my said Trustees within Twelve months after my said Wifes decease Upon Trust that they or the Survivor of them do and shall place the same out at Interest on good Security and pay and apply such interest to and for the only use of my Grandson John Reeves until he shall attain his age of Twenty one years And when he shall attain such age Then Upon Trust to pay the said Principal Sum of One hundred pounds unto my said Grandson John Reeves for his own use But in Case he shall happen to die under age Then I Give the same unto and between all my Sons and daughters then living share and share alike

I Give and Devise (after the decease of my said Wife) All that Close or ground inclosed situate lying and being in Scalford aforesaid called the Wheldale containing Six acres or thereabouts And also all that other Close or Ground inclosed in the lordship of Scalford aforesaid containing four acres and an half or thereabouts called Cox’s Close And also the North part of the said Orchard together with all my Right and Interest in the House and premises in which I now dwell called the Black Horse And also All my household Goods Stocks Cattle Chattels Rights Credits monies Securities for money and all other the rest residue and remainder of my Personal Estate and Effects (except as hereinafter excepted and Subject to the payment of all my just debts legacies hereinafter bequeathed funeral and Testamentary expences) unto my Son John Roberts his heirs executors administrators and assigns for ever

I Give unto my four Grand Children (the Sons and Daughters of my late daughter Lucy Godbere) the Sum of Forty Pounds apeice which I will shall be placed out on good security by my said Trustees Gregory Marriott and John Morris or the Survivor of them and with the Interest arising therefrom to apply the same from time to time for the mutual benefit of my said four Grand Children namely John Samuel Ann and Martha Godbere until they shall respectively attain the age of Twenty one years

And when they attain such Age Then upon Trust to pay the said Sum of Forty Pounds apeice to each of them when and as they attain the same But in case either or any of them shall happen to die before they attain such age Then I will that the share or shares of him her or them so dying shall be paid to the Survivors or survivor in equal shares

I Give to my Daughter Elizabeth Draper the Sum of One hundred and fifty pounds to be paid to her at the end of Twelve months after the decease of my said Wife And I Subject and charge my said Real and Personal Estate given and Devised to my said Son John with the true payment thereof

I Give to my said Son John my Small Silver Tankard with a Cover to be delivered to him immediately after my said Wife’s death

Also I Give to my said Son George my large Silver Tankard and my Eight day Clock in Oak Case to be taken by him at the Same time

I do hereby appoint my said Son John Sole Executor of this my last Will and Testament hereby revoking all former wills by me made

I also nominate the said Gregory Marriott and John Morris Guardians for my said Grand Children during their minority

And my mind and Will is that my said Trustees shall be at liberty to retain out of the said Trust premises all costs charges and expences they shall be at or put to in executing the said Trusts and that neither of them shall be answerable for any thing except their own Wilful neglect or default

In Witness whereof I have hereunto set my hand and Seal this Twelfth day of February one thousand eight hundred and Twenty eight

Let a Probate be made to John Roberts of Scalford in the County of Leicester Cattle Dealer the sole Executor named in the will of the deceased who died on the 2nd April last

He having been duly sworn as well to the faithful Execution of the Will as that the testators Goods Chattels and Credits without deducting any Debts owing by the deceased therefrom did not amount in value to the Sum of One hundred Pounds
