John Roberts of Scalford 1848 Will

This is the last Will and Testament of me John Roberts of Scalford in the County of Leicester Innkeeper and Grazier

I direct my just debts funeral and Testamentary Expences to be fully paid

I Give unto my daughter Ann Lock the Sum of Ten Pounds unto my daughters Sarah Jesson Roberts and Lucy Vickers the Sum of forty Pounds apiece which Legacies I will shall be paid to each of them within Twelve months after my Decease

I Give Devise and bequeath All my Real and Personal Estate and Effects of every kind and quality with all and every the Rights members priviledges and appurtenances whatsoever and wheresoever situate at Scalford aforesaid unto my Two friends John Morris and John Godber Junior both of Scalford aforesaid Graziers their heirs executors and administrators Upon Trust to permit my affectionate Wife Mary Roberts to have the free use and enjoyment thereof during her natural life for the benefit of herself and for the maintenance education and bringing up of my seven other Children namely Mary Jonathan Fanny Emma Elizabeth Joanna and Susan Roberts until they respectively attain Twenty one years And from and after the death of my said Wife Then Upon Trust that my said Trustees or the Survivor of them or his heirs do and shall sell the same in such manner as they may think proper and with the monies to arise therefrom to pay and divide the same equally unto and amongst my last named Seven Children share and share alike

And in case any or either of them shall die under age unmarried and without Issue Then the Share or Shares of him her or them so dying shall be divided amongst my all then Surviving Children

And I do appoint the said John Morris and John Godber Joint Executors In Trust of this my last Will and Testament

And for facilitating the sale of my said Real Estate and the Indemnity of the Purchaser or Purchasers thereof I do declare that the Receipt or Receipts of my said Trustees or the Survivor of them or his heirs shall be good and sufficient discharge to such Purchaser or Purchasers who shall not be obliged to see to the application of such Purchase monies or be answerable for the loss misapplication or non application thereof

And Lastly I declare that my said Trustees shall be at liberty out of the said Trust proceeds to Retain all necessary expences they may be at or put to in executing the said Trusts and that they shall not answerable for any banker broker or other Person or for any loss to the said Trust monies unless the same happen through his or their Wilful neglect or default

In Witness whereof I have hereto set my hand this 15th day of June 1848

Signed Published and declared by the said Testator John Roberts as and for his last Will and Testament in the presence of us who have at his Request in his presence and in the presence of each other at the same time set our hands as Witnesses to the due Execution thereof

John Morris, Junior, and John Godber, Junior, both of the parish of Scalford in the County of Leicester Graziers the joint executors in this will named were sworn to the truth and faithful performance thereof as usual and that the goods chattels and credits of the deceased without deducting any debts owing by him therefrom do not amount in value to the sum of four hundred and fifty pounds (£450) and that the deceased died on the 15th day of July last past
