Thomas Pickard of Wartnaby 1868 Will

This is the last Will and Testament of me Thomas Pickard of Wartnaby in the County of Leicester Cottager

I direct the payment of all my just debts funeral and testamentary expences as soon as conveniently may be after my decease

I give unto my dear Wife Eliza Pickard the legacy or sum of One hundred pounds to be paid within one calendar month after my decease

I also give to my said Wife the use of my household furniture plate linen books and other effects which may be in and about my dwellinghouse at the time of my decease during her life

I give devise and bequeath all my real and the residue of my personal estate whatsoever and wheresoever and whether in possession reversion remainder or expectancy unto my nephew John Pickard the younger his heirs executors administrators and assigns according to the nature and quality thereof respectively Upon trust to permit my said Wife Eliza Pickard to receive and enjoy the rents annual income interest proceeds and profits thereof for and during her life for her own use and benefit absolutely and from and after her decease Upon further trust as to my real estate and as to such parts of my personal estate as shall not consist of money to forthwith sell and convert the same into money (with power to give receipts for the purchase moneys which receipts shall effectually discharge the person or persons paying such moneys from seeing to the application or being accountable for the misapplication of the money expressed in such receipts to be received) and to stand possessed of the proceeds of such sale and of such part of my personal estate as may consist of money  upon trust as to the sum of Seventy pounds part thereof to divide the same equally among the children of my first Wife’s Brothers George Copley and Richard Copley and of her sister Esther Hornby share and share alike the issue any who may  be dead leaving issue representing and taking their deceased parents share and as to the residue thereof to divide the same equally between all and every the children both sons and daughters of my Brothers Richard and John Pickard who shall be living at the time of the decease of my said Wife and the issue of such of them as shall be then dead (such issue nevertheless taking only the share to which their deceased parent would have been entitled in the event of such parent having survived my said Wife) to and for his and her own use and benefit absolutely

And lastly I appoint my said Wife Eliza Pickard and my nephew the said John Pickard to younger Executrix and Executor of this my Will hereby revoking all former and other Wills by me at any time heretofore made

Proved at Leicester the first day of May 1868 by the Oaths of Eliza Pickard Widow the Relict of the deceased and John Pickard the younger Nephew of the deceased the Executors to whom Administration was granted

The Testator Thomas Pickard was late of Wartnaby in the County of Leicester Cottager and died on the twenty eighth day of December 1867 at Wartnaby aforesaid
