Michael Pennistone of Plungar 1841 Will

This is the last Will and Testament of Michael Pennistone of Plungar in the County of Leicester Farmer

I give devise and bequeath all my real and personal Estate and Effects whatsoever and wheresoever (saving and excepting my household furniture, plate, linen, china, books and clothes) unto John Caunt of Plungar in the County of Leicester Farmer and James Wright of Plungar aforesaid Cottager Upon Trust as soon as conveniently may be after my decease to sell and dispose of the same and out of the money arising therefrom In the first place to pay and discharge my just debts funeral and Testamentary expences and the expences attending the sale or sales of my real and personal Estate aforesaid

And Upon further Trust to divide the residue of the monies arising from the sale of my real and personal Estate as aforesaid unto and equally between and amongst all and every my Daughters who shall be living at the time of my decease or shall have died having left children such children to be entitled on their arriving severally at the age of Twenty one years to equal portions of the share his or her mother would have been entitled to receive if living with the Interest that may have arisen thereon

I give and bequeath all my household goods plate linen china books and clothes which shall be in my house at the time of my decease to my daughters Ruth Hall and Rachel Pennistone to be divided equally between them as they shall agree concerning the same

Provided always and I hereby declare that the receipt of my said Trustees shall be a good discharge for all monies which in such receipt shall be expressed to be received And that all persons paying any monies to them and taking a receipt for the same shall not be obliged to see to the further application of the said monies nor be accountable for the misapplication thereof

And lastly I appoint my son in law Zachariah Hall sole Executor of this my Will and I hereby revoke all former wills by me made

In Witness whereof I have hereunto set my hand and seal this First day of April in the [“year” missing] of our Lord One Thousand Eight hundred and forty one

17th Novr 1841 Zachariah Hall of Plungar in the county of Leicester Farmer, the Sole Executor in this will named, was duly Sworn to the truth, and faithful performance thereof, as usual, And that the goods, chattels and credits of the said deceased do not amount in value to the sum of Three hundred Pounds, and that the deceased died on the twelfth day of April last past
