Philip Pearson of Stathern 1892 Will

This is the last Will and Testament of me Philip Pearson of Stathern in the County of Leicester Stonemason

I revoke all former Wills and Testamentary dispositions made by me

I appoint Michael Shelbourn of Belvoir in the County of Leicester Clerk of Works and my Son Arthur Pearson (hereinafter called “my Trustees”) to be the Executors and Trustees of this my Will

I devise and bequeath all my real and personal estate to sell call in and convert into money the same or such part thereof as shall not consist of money and with and out of the moneys produced by such sale calling in and conversion and with and out of my ready money to pay my funeral testamentary expenses and debts including any Mortgage debt on my real estate which shall be subsisting at the time of my decease and at their discretion to invest the residue of the said moneys with power for them from time to time at such discretion as aforesaid to vary such investments and to stand possessed of the said residuary trust moneys and the investments for the time being representing the same Upon the trusts following (that is to say)

In trust to pay the income thereof to my wife Margaret Pearson during her life if she shall so long continue my Widow and from and after the decease or remarriage of my said Wife (whichever shall first happen)

In trust for my two sons the said Arthur Pearson and James Rimmington Pearson in equal shares

And I direct my said Trustees to stand possessed of my real estate Upon trust to permit my said Wife to receive the rents and profits thereof during her life if she shall so long continue my Widow she keeping the same in repair and insured against loss or damage by fire and from and after the decease or remarriage of my said Wife (whichever shall first happen)

I devise the house in which I now reside to my son Arthur Pearson his heirs and assigns I devise my other house to my Son James Rimmington Pearson his heirs and assigns

And I declare that it shall be lawful for my Trustees to invest all or any part or parts of the moneys for the time being available for investment arising from my personal estate by lending the same to my said sons for the purpose of employment in their respective businesses upon their personal security and I expressly declare that my Trustees shall not be in any way answerable or accountable for any loss which may arise by reason of any such investment

And I appoint the said Michael Shelbourn and Arthur Pearson Trustees of this my Will for the purposes of the Settled Land Act 1832

In Witness whereof I have hereunto set my hand by making my mark this 15th day of May 1886

Signed with his mark and Declared by the above named Testator as and for his last Will and Testament (the same having been first read over and fully explained to and apparently well understood by him) in the presence of us both present at the same time who in his presence at his request and in the presence of each other have hereunto subscribed our names as Witnesses

Proved at Leicester on the second day of March 1892 by the Oaths of Michael Shelbourn and Arthur Pearson the son the Executors to whom Administration was granted

The Testator Philip Pearson was late of Stathern in the County of Leicester Stone Mason and died on the eighth day of February 1892 at Stathern aforesaid

Personal Estate Gross £34.  No deduction.
