Henry Oswin of Scalford 1841 Will

This is the Last Will and Testament of me Henry Oswin the Elder of Scalford in the County of Leicester Yeoman

Whereas I have lately disposed of my Freehold Estate in Scalford to my son Henry Oswin for the Sum of Two hundred pounds which is to be completed at Lady day next Now I do hereby Give and bequeath the said Sum of Two hundred pounds and All other my Personal Estate and Effects whatsoever of which I shall die possessed Unto my said Son Henry Oswin and my friend William Clark of Melton Mowbray Auctioneer Upon Trust to pay my just debts funeral and Testamentary expences and Then to pay and divide All the Residue and Remainder Unto and amongst my Six Children namely Ann Barnes, John Oswin, Elizabeth Hill,  William Oswin, the said Henry Oswin and Thomas Oswin share and share alike

But in case any or either of them shall happen to die before their Shares become due and payable Then I will that the shares or share of him her or them so dying shall be paid unto and amongst the Children of such deceased Son or daughter and be paid to such Grandchildren when and as he she or they attain the age of Twenty one Years each family of such deceased Son or daughter taking their father of mothers share or portion of my said Personal Estate as the case may be

And I appoint my said Son Henry Oswin and the said William Clark Joint Executors of this my last Will and Testament hereby Revoking all former Wills by me made

And Lastly my will is further that my said Trustees shall be at liberty to Retain out of the said Trust monies all necessary costs charges and expences they may be at or put to in executing the said Trusts and that neither of them shall be answerable for any thing except his own wilful neglect or default not one for the other but each for his own acts deeds or defaults

In Witness whereof I have hereunto set my hand and seal this Twenty Seventh day of September one thousand eight hundred and thirty six

Signed sealed published and declared by the said Testator Henry Oswin the Elder as and for his last will and Testament in the presence of us who have at his request in his presence and in the presence of each other set our hands as witnesses to the due Execution thereof

Henry Oswin of the Parish of Scalford in the County of Leicester yeoman and William Clark Auctioneer of the Parish of Melton Mowbray the Executors in this will named were duly sworn to the truth and faithful performance thereof as usual and that the goods Chattels and credits of the deceased without deducting any debts owing by him therefrom do not amount to the sum of four hundred and fifty pounds and that the deceased died on the seventh day of February last past
