Joseph Musson of Stathern 1805 Will

This is the last Will and Testament of me Joseph Musson of Stathern in the County of Leicester yeoman

I give and devise my Copyhold Messuage with the Appurtenances in Stathern aforesaid (Which I have surrendered to the use of my Will) to my son John Musson his Heirs and Assigns for ever

All the rest of my Estate and Effects both real and personal I give devise and bequeath unto my friends the Reverend William Greenwood and John Selby Farmer both of Stathern aforesaid their Heirs Executors Administrators and Assigns upon the Trusts hereinafter mentioned

In the first place to pay my debts and funeral expences and the following legacies within six months after my death viz to my two Grand-children John and Mary Musson Ten pounds apiece and to my Servant Mary Mason Twenty pounds

In the next place to raise Thirty pounds and place the same out at Interest and pay such interest into the hands of my daughter Fanny Newley for her sole and separate use for her life and after her decease to pay the Principal Sum of Thirty pounds unto such of her Children as shall be living at her death

And upon further trust that my said Trustees do out of the produce of my Estate maintain and cloath my eldest Son Joseph in every way comfortable for his life

And as to all the rest and residue of my Estate and Effects in trust for the Benefit of my son the said John Musson to be conveyed and vested in him his Heirs Executors Administrators and Assigns at the Age of Twenty one years or day of Marriage but in case of his death before the said Estate shall become vested then upon trust that my said Trustees do sell my real Estate and the money arising therefrom together with my personal property shall be a resulting trust for the benefit of my personal representatives in the same manner as my personal property would have been divided had I died intestate

Provided always that notwithstanding the whole of my estate is charged with the Maintenance of my Son Joseph my son John may after he shall come to age dispose of my said real and personal Estate or any part thereof provided the Sum of Four hundred pounds is placed in the hands of my trustees to be by them put out at Interest for the Maintenance of my son Joseph for his life

And I do appoint the said William Greenwood and John Selby joint Executors of this my last Will and Testament also Guardians of said son John during his minority

In Witness whereof I the said Joseph Musson the Testator have hereunto set my hand and seal this thirtieth day of December in the year of our Lord one thousand eight hundred and three

Signed sealed published and declared by the said Joseph Musson the Testator as and for his last Will and Testament in the presence of us who have subscribed our names as Witnesses at his request in his presence and in the presence of each other
