David Milnes of Nether Broughton 1854 Will

In the name of God Amen I David Milnes of Nether Broughton in the County of Leicester master Bricklayer being in health of body sound memory and understanding thanks be to God do make, declare and confirm this as my last Will and Testament, hereby revoking and declaring all other Wills at any time made by me to be null and void

I give and bequeath unto my dear Wife Elizabeth Milnes my House and Garden standing, lying, situate, or being at Nether Broughton aforesaid in the County of Leicester, adjoining the Turnpike Road, leading from the town and county of the town of Nottingham, to Melton Mowbray in the said County of Leicester, together with all my Household Furniture and chattels of what kind soever they may be on the premises of my said House at the time of my Death, wheresoever and whensoever it may happen, for and during the term of her natural life without any let, or hindrance whatsoever

Also my Will further is that, after the decease of my said dear Wife Elizabeth Milnes, my said House and Garden, together with what Furniture and chattels which may remain and be on the said premises after my said dear Wife’s decease, shall be sold and all the money arising from such sale to be equally divided, share and share alike, between my Daughters, Ann, the Wife of John Wilson, Elizabeth, the Wife of William Bonser, and Maria Milnes

And I do hereby nominate, constitute, and appoint John Wartnaby of Broughton Sulney, in the County of Nottingham, Miller to be the sole Executor of this my last Will and Testament

In Witness whereof I the said Testator, David Milnes have hereunto set my hand and seal this Thirteenth day of October in the year of [“our” missing] Lord One Thousand Eight Hundred and Forty Eight

Signed, sealed, declared and published, by the above named David Milnes, as and for his last Will and Testament in the presence of us who, at his request and in his presence have subscribed our names as Witnesses thereto

John Wartnaby of Broughton Sulney in the County of Nottingham Miller the sole Executor in this Will named was duly sworn to the Truth and faithful Performance thereof as usual and that the Goods Chattels and Credits of the Deceased do not amount in value to the Sum of One Hundred Pounds and that the Deceased died on the twenty second day of July last past

8th November 1854

Exhibited before the Reverend John Wing Clerk MA and Surrogate and Probate decreed to pass Seal to the above named John Wartnaby in the presence of
