This is the last Will and Testament of me Thomas Miller of Plungar in the County of Leicester Publican

First I order and direct that all my just debts funeral and testamentary expenses be paid by my Executors hereinafter named out my Personal Estate

I give and bequeath unto my Son Thomas Miller the younger my Boat now use on the Nottingham and Grantham Canal with all the materials and appurtenances thereunto belonging for his own use and benefit

I give and devise unto my Wife Mary Miller All those my three freehold messuages or tenements with the yards gardens outbuildings and appurtenances thereunto belonging situate at Plungar aforesaid now or late in the respective occupations of John Simpson Ann Haynes and Isaac Welbourn To hold the same with the appurtenances unto my said wife Mary Miller and her assigns for and during the term of her natural life for her own use and benefit And from and immediately after her decease I give and devise the said freehold messuages thereto belonging Unto and to the only proper use of my five children William Miller Thomas Miller the younger George Miller Robert Miller and Charlotte Miller in equal shares and proportions and to their several and respective heirs and assigns for ever as tenants in common and not as joint tenants

I give and bequeath unto my brother John Miller of Plungar aforesaid Farmer and my Brother in Law Benjamin Brethwaite of the same place Labourer All my household goods and furniture ready money and securities for money stock in trade and all other my personal estate and effects whatsoever and wheresoever (not hereinbefore specifically given and disposed of) In trust to permit and suffer my said wife Mary Miller to have the use of all such parts thereof as shall not consist of money or securities for money for and during the term of her natural life for her own use and benefit and also to pay the interest arising from such parts thereof as shall consist of money or securities for money unto my said wife for and during the term of her natural life for her own use and benefit

And from and immediately after the decease of my said wife then In trust to divide all my said personal estate equally between and amongst my said five children share and share alike and their respective executors administrators and assigns

And lastly I do hereby nominate constitute and appoint my said brother John Miller and my said Brother in Law Benjamin Brethwaite Joint Executors In Trust of this my last Will and Testament and hereby revoking and making void all former Wills by me heretofore made I do declare this only to be my true last Will and Testament

In Witness whereof I the said Thomas Miller the Testator have to this my last Will and Testament contained in this and the preceding sheet of paper set my hand at the bottom or end of each sheet thereof this twenty ninth day of November in the year of our Lord one thousand eight hundred and fifty one

This and the preceding Sheet of paper were severally signed by the above named Thomas Miller the Testator and the same were by him published and declared as and for his last Will and Testament in the presence of us present at the same time who in his presence at his request and in the presence of each other have hereunto subscribed our names as witnesses
